Vayeitzei, Bereishis 29:27. Working During the Days of Sheva Brachos

Last night I attended my niece's marriage to a wonderful young man, Yaakov Guttman from Baltimore, a very dear talmid of my father in law, Harav Reuven Feinstein.  As we sat down for the Kabalas Panim, the chasan saw that nobody had given my father in law anything to eat, so he jumped up and ran to the buffet table to get something.  I asked him, what does he think Chazal meant when they said Chasan domeh l'melech, that a chasan is like a king?  Doesn't he think it might mean that he should be sitting and having others serve him, not running to serve someone else?
He is a very bright fellow, so he said that he thinks Chazal meant that a chasan can do whatever he wants, and he wants to bring something to the Rosh Yeshiva to eat.
It's so cute when a fresh chasan thinks that getting married means that he can do whatever he wants. Cuteness aside, my brother in law, Harav Yosef Asher Weiss, agreed with the chassan.  He said the din melech is in the sense that he is poreitz lo geder, he doesn't have to take other people into consideration, he is the focal point of the week, so if he has hana'ah from serving the Rosh Yeshiva, he can do what he wants.

I went over to Rabbi Moshe Heinemann and asked what he thought of the question, and being a posek, he answered that before the Chupah there is no din Chasan yet.  Of course he's right, and I saw that Rav Ovadia says this in יבי״א ח״ו אהע״ז סימן ח׳, where he says befeirush that during kiddushin the din domeh lemelech does not apply and he may do melacha.

I told him that even if he did have a din Chassan, I thought there would be two reasons to be meikil.  First, you have the Mordcheh (Hagahos Mordechai) in Gittin 5:461.  A kohen, a talmid of Rabbeinu Tam, washed Rabbeinu Tam's hands. Another talmid asked that the Yerushalmi says that one may not benefit from the service of a Kohen because of the rule of וקדשתו, which mandates that we show deference and respect to Kohanim.  Rabbeinu Tam answered that the issur only applies when he is wearing bigdei kehuna.  The talmid said, if that is true, then all the kohanic restrictions should no longer pertain, and Rabbeinu Tam was silent.  Rabbeinu Peter answered that a Kohen can be mochel on his honor.
אין כהן נרצע, מעשה בכהן שיצק מים ע״י ר״ת, והקשה לו תלמיד אחד הא שנינו בירושלמי, המשתמש בכהונה מעל, והשיב לו אין בהם קדושה בזה״ז, דקי״ל בגדיהם עליהם קדושה עליהם, ואם לא, לא

והשיב הר׳ פטר, דנהי דיש בהכי קדושח יכול למחול, כדאמרינן בפ״ק דקידושין אין כהן נרצע מפגי שנעשה בעל מום, והשתא בלא הך טעמא קשה האיך מצי משתעבד בי׳ אלא ודאי מצי מחיל והלכך איצטריך לטעמא דבעל מום דאל״כ הי׳ נרצע

This is brought in OC 128:48 in the Rama.  The Taz asks, the pasuk of וקדשתו applies even against the will of the kohen, because the Gemara says that if a Kohen can be mochel marries a divorced woman we pressure him to divorce her because וקדשתו whether he likes it or not!  The Taz answers that really Rabbeinu Tam knew that it was muttar because if the Kohen washes the hands of a talmid chacham, that is the biggest kavod for the Kohen himself, to serve Rabbeinu Tam, but out of humility Rabbeinu Tam couldn't say that.
ונ״ל הטעם דיכול למחול הוא משום דיש לו הנאה מזה ולא אסרה התורה עליו מידי דהוא ניחא לי׳ בכך, וההוא כהן שיצק מים לר״ת ודאי הוה ניחא ליה שזכה לשרת בקודש וזו היא קדושתו, ונראה דהא דשתק ר׳׳ת, לא משום שלא ידע להשיב, אלא שלא רצא ליטול שם ת״ח עליו ולומר שבשביל זה הוא מותר

Rabbi Heinemann seemed to agree with the comparison to the Taz.  But then I told him that (even though it was my tzushtell) it's not so simple, because there might be a unique chumra by a chassan.  If the expression in Pirkei d'Rebbi Eliezer that חתן דומה למלך is taken at face value, as many poskim do, to be the source for prohibiting a chasan from doing work, then the story with Rabbeinu Tam might not be a raya.  There is a tremendous difference between honoring a kohen and honoring a king.  By a king, the rule is that מלך שמחל על כבודו איו כבודו מחול, so mechila should not work by a chassan.  Even after the Taz, it still is a mechilla.

Rabbi Heinemann answered that even so, a chassan could be mochel.  By a king, he cannot be mochel, because the honor is that of Klal Yisrael, and he can't forgo the honor of Klal Yisrael.  A chassan's honor is his own, and he can be mochel even if he is like a melech.

I disagreed.  The lomdus of Melech does not have to apply to a chassan.  If one of the defining characteristics of being a melech is not being able to be mochel, the idea that חתן דומה למלך requires that this apply to a chassan as well.  It's a simple example of דון מינה ומינה..

My second reason to be meikil was that Chazal say מאן מלכי רבנן, so the chassan's being domeh l'melech wouldn't really matter.  He can't be mochel kvodo for a commoner, but he certainly could honor a fellow melech.  However, I realize that this is a take-it-or-leave-it svara.

At the Seudah, I was sitting near Reb Dovid Feinstein,  I told him about the discussion, and he answered with an arrow to the center of the target.  He said that the Gemara in Kiddushin 32b says מעשה ברבי אליעזר ורבי יהושע ורבי צדוק שהיו מסובין בבית המשתה בנו של רבן גמליאל והיה רבן גמליאל עומד ומשקה עליהם, that Rabban Gamliel was pouring the wine into the glasses of the Gedolim at his son's wedding.  Reb Dovid said that we see that even a Nasi, like Rabban Gamliel, can serve talmidei chachamim at a wedding.  I said, but Rabban Gamliel was a Nasi, not a Melech, and by a Nasi, the Gemara there says נשיא שמחל על כבודו כבודו מחול.  But a chassan is  not just a Nasi, he's a melech, and  מלך שמחל על כבודו איו כבודו מחול, so mechila should not work.  Reb Dovid smiled and said that even if a Chassan is דומה למלך, he is not more דומה למלך than a Nasi is דומה למלך, and if a Nasi can serve a talmid chacham at a wedding, the chassan can, too.


IMPORTANT UPDATE:
I thank the anonymous commenter that asked how I would explain that Moshe Rabbeinu served Yisro and Aharon and others at a seuda.  Moshe Rabbeinu had a din melech!  How could he be mochel?  The point of the comment was to imply that din melech is not melech, as far as the hetter to serve others.  Indeed, he was 100% right.  I found that the Makneh in Kiddushin 32b asks the kashe from Moshe serving the others.  The Makneh answers that the din by a king that he can't be mochel, that אין כבודו מחול, is only because of the passuk שום תשים, and that halacha only began when they entered Eretz Yisrael.

Rav Shteinman addresses this question as well, and he is mechadeish that Moshe Rabbeinu's malchus, just like Shmuel's "Malchus," was a din of shlichus of the Ribono shel Olam.  Since the Ribono shel Olam takes care of people, that kind of Melech can take care of people too.  But the kings that were nimshach, who came after Klal Yisrael asked for a king, that kind of malchus is  אין כבודו מחול.

Either way, as he pointed out, if Moshe Rabbeinu could serve his guests, a chassan can, too.  This turns out to be similar to what Reb Dovid said.

I recently (November 2016) got an email containing a dvar Torah from Harav Aryeh Leib Keller, who learns in the Dirshu chabura in Lakewood, the son of a dear and worthy friend, Harav Shmuel Yeshaya Keller.  He is a tremendous yad'an, and he writes on this topic, particularly the sefer Hamakneh's question.  He says what he calls a new pshat, but I think it might be the hesber in what the Sefer Hamakneh himself answers. In any case, the mareh mekomos and the way it's written are outstanding.

ובראה לומר בכ״ז דשאני דין מלך דמשה ויהושע משאר מלכים, ויש להקדים כמה הקדמות.
הנה בריש משלי עה״פ ׳משלי שלמה בן דוד מלך ישראל׳ פירש הגר״א דשלמה עשה שלשה ספרים בס׳ משלי, אחד על חכמה, והשני על מוסר, והשלישי על התורה, ונגד אלו השלשה אמר כאן ג׳ דברים, נגד חכמה אמר ׳שלמה׳, דכתיב ביה ויחכם מכל ארם, ונגד מוסר אמר ׳בן דוד׳, שהיה חסיד גדול, וכשנאמר עליו שחיה בן דור מסתמא היה ממלא מקום אבותיו, ונגד תורה אמר ׳מלך ישראל, כמ״ש ׳בי מלכים ימלכו׳ (משלי ח, טו), עכ״ד.

ובזהי״ל עוד דבאמת אין סתירה לומד דויהי בישורון מלך הולך על מלכות התורה דמשה וגם על מלכות הקב״ה, דיסוד מלכות משה הוא התורה, ומלכותו באה לו מנותן התורה, והממליך מלכים לו המלוכה, ולזה אם שייך ענין מלכות של תורה כגברא ה״ז מודה באצבע על מציאותו של הממליך ועל מלכותו בעולמו, ותורה דיליה היא הממליך, ויהי בישורון מלך, בי מלכים ימלוכו, ודוק.
והנה עה״פ ויהי בישורון מלך הביא ראב״ע בשם רבי יהודה הלוי ׳כי המלך רמז לתורה. וכן היה מפרש אין מלך בישראל (שופטים יה, א)׳. וצ״ב כונתו. וע״פ הנ״ל נראה דר״ל דיסוד ענין דמלך הוא ע״י כה התורה, ואם נאמר ׳אין מלך בישראל׳ הכת ה שלא היתה תורה בישראל, ודוק. תראה עוד בכתתו ע״פ מאה״ב(איכה ב, ט) מלכה ושריה כגוים אין תורה, ודוק.
ולפי הנ״ל נראה דעיקר ענין ׳מלך ישראל׳ מצד הגברא הוא שהמלך הומלך ׳על ידי׳ תורה, וכמ״ש הגר״א ׳הבל הוא על ידי התורה׳, ומלכותו באה מעצמות האדם שקנה תורה, בי מלבים ימלכו, והיא ׳מלכות של תורה׳. אלא דמשנכנסו ישראל לארץ נתחדשה מצות מלך של שום תשים עליך מצד העם, ומלך מסוג הזה באה לו מלכותו ממה שנתמנה ע״י נביא להיות מלך על העם, ואף שאין הגברא מצד עצמו מלך של תורה כמו שהיו מוסרי התורה משה ותלמידו יהושע! וכיון דדיני מלך הללו נובעים מחובת העם אין חובת כבודו מצד תורתו אלא מדיני מצות העם.
ובזה עלה בידינו כבר להבין איך שייך שהיו משה ויהושע מלכים ממש ואעפ׳׳כ נקרא שאול ׳מלך ראשון לישראל׳, דלהנ״ל היה שאול הראשון שמלכותו לא היתה מלכות של תורה, אלא מלכות של ׳שום תשים׳, ע״י שמינוהו העם להיות מלך עליהם ולצאת לפניהם וכר, ועד אז היתה המלכות שייכת למקבלי ומוסרי התורה בלבד, משה קבל תורה מסיני ומסרה ליהושע. ומדוייק היטב לשון המדרש שהבאנו לעיל דשאול היה מלך ראשון ׳שיעמוד על בניך׳, דהוא היה הראשון שמלכותו היתה ׳על בניך׳, ולא מלכות של תורה, וודוק.
ולפי׳ז א״ש מש״ב הראב״ע בפ׳ בלק דשאול מלך ראשון היה אף שהוא עצמו כתב בוישלח דמלך מלך לבני ישראל הוא משה! וכך א״ש מש״ב הכם״מ(מלכים א, י) רשאול היה ראשון שלא היה מלך לפניו, רע״פ הנ״ל היה שאול המלך הראשון שנמשה למלכות של שום תשים, ולא היה כה מלכותו ע״י מלכות של תורה.
ובזה נראה לומר דבודאי אף במלכותו של משה נהגו דיני מורא אף שלא נתמנה מדיני שום תשים שתהא אימתו עליך, אלא דכיון דמלכותו היתה מלכות של תורה, ע״י שהיתה בו ממשות התורה, לכן היו דיניה שייכין במחילה כרברי התוס׳ לענין כבור ת״ח, וכמו שיכול ת״ה למחול על כבודו דתורתו ריליה, כך מלכות התורה רבי מלכים ימלוכו הוי מלכות עצמית ושלו למהול, ולכן מדע״ה היה יכול למחול כבוד מלכותו שהוא כבוד התורה בעצם.
ולאור כל הנ״ל היה מקום לפרש דבודאי לכ״ע היה משה מלך ממש, אלא כיון שמלכותו היתה מלכות של תורה, ׳מלך ישראל׳, לכן לדעת רש״י נע״פ המדרש] לא היה שייך מלכות ממין זה כלל לעמוד כנגד מלכותו של עשו! וכהכרה ענין הח׳ מלכים הוא דכמו שהיו ח׳
מלכים ששלטו על אדום בכה, כך עלו ח׳ מלכים מיעקב שמלכותן היתה בדין שום תשים מצד העם עצמם, ולא דק מצד מלכות הגברא, ומלכות מסוג זה התחילה בישראל רק כתקופת שאול ודוד. נוכמ״ש שימה לנו מלך לשפטינו ׳ככל הגוים/ ודוקא מלכות באופן זה נכנס כחשבון כנגד מלכות עשו], ודוק.
ובדעת הראב״ע שהעדיף לפרש קרא דמלך מלך לבני ישראל במשה י״ל רכיון שהנהיג את העם במלחמות וגם פרכס אותם כמלך היה משה ג״ב בכלל זה, ושפיר מצינו לפרש העמדת מלכות משה כנגד מלכות עשו, ודוק. ולדברי הספורנו דמשה היה מלך במצות ה׳ מקרא דויצום אל בני ישראל. על דרך וצוך לנגיד, א״כ כבר לפני מ״ת היה מלך. והיינו דס״ל דאף משה היה לו דיני מלך חוץ ממלכות התורה שלו, וכן הרשב״ם שכתב שהיה מלך ע״י ׳שהושיע את ישראל׳ ס״ל שהיה מלך חוץ ממלכות התורה שהיתה לו, ודוק.

That's the part of the vort I enjoy.  But since I mentioned the idea that there might be a prohibition on a chassan from working during the week of Sheva Brachos, here are the basic facts about the minhag/halacha.  
In EH 64:1 the Mechaber and Rama both say that a Chassan should spend the week focused on the joy of the new marriage and not do any work.  Among the sources for this halacha, there are those that derive this from the passuk in our parsha (29:27-8) of מלא שבע זאת.........ויעש יעקב כן וימלא שבע זאת.  Others derive it from the Braisa in PD'RE of החתן דומה למלך.   The Braisa says מה המלך אינו עושה מלאכה אף חתן אינו עושה מלאכה   (That's why I labeled this Parshas VaYeitzei.)
Although there is a natural tendency to assume that the expression  החתן דומה למלך is descriptive, not prescriptive, we find many Rishonim that relate the issur melacha to this Braisa, including the Ran and Ramban in the beginning of Kesuvos.
Ran:
שאם אתה אומר תבעל בה' למחר משכים לאומנותו והולך וכו' לא שיהא מותר במלאכה אלא שחכמים ייחדו לו ימים הללו ימי בטלה והכי איתא בתוספתא התקינו שיהא בטל ג' ימים ה' וערב שבת ושבת שלשה ימי בטלה נמצא שמח ג' ימים וה"ה נמי לשבעה של בתולה שחתן אסור בהם במלאכה והכי איתא בפרקי רבי אליעזר בפי"ו החתן דומה למלך מה מלך אינו יוצא לשוק לבדו אף חתן אינו יוצא לשוק לבדו מה המלך אינו עושה מלאכה אף חתן אינו עושה מלאכה ובאגדה אמרו החתן דומה למלך מה מלך אינו עושה מלאכה אף חתן אינו עושה מלאכה

 The various interpretations can be found in Rav Vozner's Shevet HaLevi (8:282), where he says there are three shittos about this.  (That's an oversimplification, because there's a lot of overlap among the disparate shittos about the reason and the application.)
1.   The prohibition is only so the simcha is not diminished, and if the two agree that it's best to go do melacha, it's fine.
2.  It's an issur like Chol HaMoed, and mechila won't help, but davar ha'avad would be muttar.
3.  It's a real issur, and mechila and davar ha'avud won't be mattir.
 הנושא בתולה צריך לשמוח עמה ז׳ ימים שלא יעשה מלאכה, ולא ישא ויתן בשוק : הנה בגדר איסור מלאכה בחתן הרבה מדובר בזה, ועיין פת״ש ומקנה, ובעצי ארזים, ועיין באוצה״פ כאן, ובשו"ת שבט הלוי ח״ו סי׳ ר״ו אות ב׳ כתבתי בעניי בקיצור דג׳ דרכים באיסור מלאכה לחתן
י״א דאין איסור מלאכה מצד עצמו אלא מצד בטול שמחתם, וממילא מלאכה קלה בתוך הבית ובפנים שאינה מבטלת השמחה אינו בכלל איסור זה וזה דעת מהרי״ט צהלון סי׳ קע״ח בפנים שרמז הסת״ש כאן, ולדעתו גם מלאכה גמורה מהני מחילה, וכ״ה פשטות הרמ״א כאן ס״כ וזה דעת הלבוש והגאון עצי ארזים כאן.
 הדרך השני שיש איסור מלאכה מצד עצמו ולא מהני מחילה וכדעת הח״מ וב״ש בשיטת הרמ״א אבל צריכים להגדיר עד היכן הולך איסור מלאכה, ודעת גאון חזון איש אה״ע סי׳ ס״ד- ז׳ נראה דלא חמירי מחוה״מ, ודבר האבוד מותר, ותוס׳ כתובות ד׳ ע״א מבואר דחתן קיל ממועד ע״כ הרי דלהחזק איש עצמו לא ברירא לי׳ ועכ״פ דעתו דודאי לא חמור ממועד.
 ודעת שלישית מש״כ גס׳ בית דוד הספרדי הובא בתשובת מנחת אלעזר ח״ג סי׳ נ״ז דאפילו דבר האבוד אסור, ובעל מנחת אלעזר דחה לה כצדק, וכן דעת הגאון מנחת פתים כאן להקל, ולענין מלאכת כתיבה לא זו לדעת הסוברים דהוא רק משום בטול שמחה דודאי כתיבה קלה שמותר כשהוא בתוך הבית ואינו יוצא למלאכתו,ואינו גורם בטול שמחתה עי״ז, אם לא שאינו פוסק מלכתוב כל סיום בלי משים לב בזה ודאי בגדר בטול שמחה. אלא גם לשיטת האוסרים מלאכה מצד עצמה, והגדר כמו חוה״מ מכ״מ גס בחוה״מ איכא כמה צדדים להקל כמבואר או״ח סי׳ תקמ״ס, ו ק אפשר לסתיר איגרת שלומים לחתן.


Rav Eliezer Waldenberg (2:57) (paraphrased, and mentioned above,) is also meikil.
  חתן שהוא אופה שכיר, ואם יעדר מעבודתו כל שבעת ימי המשתה יפסיד משרתו ואחר יתפסנה, והכלה מסכמת שיעבוד, אך הח״מ והב״ש ביארו לרמ״א דלא מהני מחילתה, מיהו בזקן אהרן (בזמן מהר״י בי רב — סימן רט״ו) ומהריט״ץ (סימן קע״ח) ופרח מטה אהרן(ח״ב סימן ס״ה) והובא בפתחי תשובה ס״ל דחתן לא חמור כל כך כמו אבל ושותפו של החתן רשאי לעבוד בחנות, ואם אבל מותר בדבר האבד קל וחומר חתן

Although the Chinuch holds that the woman's mechila doesn't help for נקי יהיה לביתו, nobody really paskens like that.


I just saw that in our Parsha, Rav Carlbach in this Chavatzeles HaSharon on or around page 460 brings that the Rogotchover brought a raya from the Rambam in 6 Aveilus 5 that the din of domeh le'melech and the issur melacha does not apply to the Kallah.  I have yet to find the Rogotchover inside, and I would pay cash money to see it.

I'm just curious: How do you understand the fact that Moshe, despite having the status of a melech, served Yisro, Aharon and the ziknei Yisroel at the meal that they partook of when Yisro came to Bnei Yisroel in the midbar? This was a public event, and yet Moshe, the king, stood and served the others. So what light does Moshe's serving shed on the permissibility for a chosson to serve others (especially a talmid chacham) if he chooses to do so?

      Your report is late, so here's mine. The Makneh answers that the din that a melech cannot be mochel stems from Som Tasim (which creates a chiyuv of Eimah on the people) and that din was not operative until they enterered Eretz Yisrael.
      Rav Steinman says that the malchus of Moshe was just as a shaliach of the Ribono shel Olam, and we find that the Ribono shel Olam does things for people, so His shaliach can, too. But the malchus of an annointed king is called "Malchus Atzmo," and he cannotn be mochel that. I don't follow the svara, but there it is.

  2. Seems to me that both justifications for Moshe's actions may quite possibly apply to a chosson as well. There is no mitzvah of som tasim to create a chiyuv of eimah on the people to fear a chosson, so he may choose to be mochel his kavod if he wants to. And the chosson is not annointed, just as Moshe was not.

    1. That's true. I'm going to have to edit the post. That's probably the idea behind Reb Dovid's "even if a Chassan is דומה למלך, he is not more דומה למלך than a Nasi is דומה למלך, and if a Nasi can serve a talmid chacham at a wedding, the chassan can, too."
