Korach, and the Mechila of a Talmid Chacham

Rav Steinman שליט"א has been especially busy lately.  Besides the endless demands on his time for his help and opinion and brachos for matters involving Torah and the community and the poor and the sick, he has lines of people out the door who are coming to ask him for mechila (as per his grandson.)

The problem is that there have been differences of opinion in the Torah community about important matters of policy, and while there is probably nothing wrong with choosing sides, many people stupidly talked with chutzpah and azus against Rav Steinman.  Naturally, some of them began to suffer terrible things in their lives and the lives of their loved ones, and they realized that it was because of being mevazeh a talmid chacham and tzadik.  So they're all coming to ask mechilla.  I wish them well, and I hope that Rav Steinman's wholehearted mechilla will help, but it's not at all clear that his mechilla will save them.  Fortunately for them, Rav Steinman's opinion is that if they are sincerely repentant and they personally ask for mechilla, the mechilla of the Talmid Chacham will save them from punishment, and it's logical that his shitta would be accepted by the Beis Din Shel Maalah where he was the victim of the bizayon.

We recently read of Miriam's punishment for being disrespectful to Moshe Rabbeinu.  Certainly, Moshe was mochel his older sister with a whole heart, but she was punished anyway.

Why didn't Moshe Rabbeinu's mechila help?  Why was Miriam punished? Why didn't his mechila make it as if nothing had happened?  As far as the Adas Korach, Moshe wasn't mochel them.  But theoretically, would Moshe Rabbeinu's mechilla have saved Korach and his people?

So here is the question of the week:
If a Talmid Chacham, a Gadol HaDor, is maligned, and he forgives the person who did it, is that person absolved?

(Speaking against Moshe Rabbeinu involved two sins- denigration/bizayon of a Talmid Chacham and Lèse-majesté/moreid b'malchus, because Moshe Rabbeinu also was the leader and king of that generation.  But in the parsha of Miriam, and, lehavdil, the parsha of Korach, it appears that the main aveira was speaking against Moshe Rabbeinu as Talmid Chacham, the conduit through which Klal Yisrael received the Torah.)

The Gemara (Kiddushin 32b) says that a king cannot absolve acts of disrespect against him.  A king's mechila on his honor is not a mechila. But a Talmid Chacham that is mochel on his kavod, the mechila is effective.

It stands to reason that if a Talmid Chacham can be mochel on his kavod beforehand, and allow others to treat him without special deference, he ought to be able to forgive an insult after it is made.  The svara is that the Torah is "his," and he is the baal davar on what is his own.  If so, Moshe Rabbeinu should have been able to be mochel.

However, the Rambam (TT 5:11, based on Kid 32b) says that mechilla only removes the obligation of "Kavod."  Even after mechilla, one must give "Hiddur" to a Talmid Chacham.
הרב המובהק שרצה למחול על כבודו בכל הדברים האלו או באחד מהן לכל תלמידיו או לאחד מהן הרשות בידו. ואע"פ שמחל חייב התלמיד להדרו ואפילו בשעה שמחל

The peirush Avodas Hamelech, (also here) (from Harav Menachem Krakovsky, a talmid of Reb Chaim and the Netziv, Reb Moshe Feinstein's first cousin, my wife's first cousin twice removed, the son in law of Reb Elyah Pruzener,) says that even after mechila, bizayon is assur.


ואע"פ שמחל חייב התלמיד להדרו ואפילו שמחל. כפל רבנו הדברים, והכונה דאפילו אם מוחל גם ההידור מ"מ חייב התלמיד להדרו, ולכאורה צ"ב מנין לו לרבנו הא, והרי מקור דבריו הוא מעובדא דרבא דאקפיד על רב מארי ורב פנחס בני רב חסדא דלא קמו מקמיה אע"ג דדלי להוא כסא וכן רב פפא דאקפד על ר' יצחק בריה דרב יהודה שם, משום דאפילו הכי הידור בעו למיעבד ליה, ושם הרי אקפדו על זה, ומנין שאף בשעה שמוחל גם ע"ז שחייב לעשות הידור וצ"ל דס"ל לרבנו דאם אינו עושה הידור הוא בגדר בזיון, וראיה לזה דהרי אמרו בתורת כהנים ובמדרשים שהבאנו לעיל איזהו הידור שאמרה תורה והדרת פני זקן שלא יעמוד במקומו ולא ישב במקומו וכו' ואמרו בפ"ז דמס' דרך ארץ זוטא איזהו מכבד וכו' ואיזהו מבזה לא ישב במקומו וכו' הרי דאם אינו עושה הידור בכלל בזיון הוא, וזהו טעמם דרבא ודר"פ דאקפידו על שלא עשו להם ההידור והרי הם מחלו על כבודם, ובעל כרחך דזהו בזיון ובזיון אין הרב יכול למחול ועי' בשו"ע סי' רמ"ב סל"ב לא משמע כן, ויהיה בזה דעת רבנו כדעת הראב"ד ז"ל דאף שהרב יכול למחול על כבודו אבל לא על בזיון והוא משום דלגבי בזיון שוב לאו תורה דיליה הוא ואינו יכול למחול, ואף דרבנו ס"ל באבידה בזקן ואינו לפי כבודו דרשאי להחמיר על עצמו אף דזהו בגדר בזיון וכבר ראיתי למחברים שרוצים לתלות שיטת הראב"ד ז"ל לענין בזיון בפלוגתא זו, ולדעתי אין דין זה שייך למבזה כבודו בשביל כבוד שמים וקיום מצוה, והארכתי בזה במקום אחר לתרץ קושית הטורי אבן ז"ל על שיטה זו מהא דאמרו בקדושין ל"ב ברב הונא דקרע שיראי באפי בריה וקאמר ודלמא רתח וקא עבר על לפני עור, ומשני דמחיל ליה ליקריה הרי דיכול למחול גם בזיון, אבל אכ"מ יותר



The Turei Even Megilla 28 also brings from the Rivash quoting the Raavad that mechilla does not help for Bizayon.
. וי״ל דאע״ג דהרב רשאי למחול על כבודו הני מילי כגון בקימה והידור רשאי למחול עליהם כיון דתורה ליליה היא אבל לתת כבודו לאחר אם הוא ע״ה כבודו לאחר לא יתן דאיכא משום משנאי כדפירש״י שגורם לבני אדם לשנאותו שהרואה ת״ח שפל לפני ע״ה אומר אין נחת רוח בתורה . ואיכא זלזול לכבוד התורה ולומדיה . וכה״ג כתב הריב״ש בתשובה סימן (רכ) בשם הראב״ד דאע״ג דהרב שמחל על כבודו מחול דתורה דילי' היא היינו במידי דלית בי׳ בזיון אלא באותן דברים שחייב אדם לנהוג כבוד לרבו מחמת תורתו כגון לעמוד מפניו וכיוצא בזה יכול למחול. אבל על בזיונו אינו יכול למחול אדרבה אסור למחול דהתורה מתבזה בכך. ודמי למאי דאמר התם האב שמחל על כבודו, כבודו מחול דליכא למימר שהאב יכול למחול לבן לומר לו דברי חרופי' וגדופי׳ והיינו דאמר בפ״ג דיומא דת״ח צריך שיהא נוקם ונוטר כנחש לדבר תורה

(At the end of that piece, the Turei Even changes it a little and says that a father's mechilla might help, but even so, a Rav's mechilla is neither mattir nor metaheir bizayon.)


The Brisker Rov says something along the same lines.  He says that the Rambam holds that the Mechila discussed in Kiddushin refers to the special obligation of kavod that a talmid has to his rebbi.  But the general honor due to a Talmid Chacham cannot neither be forgone nor forgiven.  The Brisker Rov is brought down in Shiurei R Dovid Povarsky BM II page 351

ולפי"ז כתב עוד, דהנה בגמ  בקידושין שם (דף לב :) איתא, דאף דהרב שמחל על כבודו כבודו מחול, אפ"ה הידור בעי למיעבד, [ולכן הקפידו רבא ורב פפא על שלא קמו מפניהם, ע"ש] ופירש"י [הידור בעי למיעבד] לנוע מעט כאילו רוצה לעמוד מפניו, ע"כ .
משמע דמעיקר הדין באמת אינו מחויב לקום, כיון דפקע חיוב ההידור ע"י שמחל, וכן מבואר בשאילתות, ורק דהקפידו שם משום דעכ"פ אינהו בעו למיעבד ליה הידור קצת, כאילו רוצים לעמוד מפניו, ואע"פ שאין בזה שום דין של חיוב.
אכן כתב הגרי"ז דהרמב"ם שם (פ"ה הי"א) כתב, ואע"ג שמחל , "חייב" התלמיד להדרו ואפי' בשעה שמחל, ע"כ, משמע מדבריו דאף אחר המחילה איכא חיוב הידור.
וביאר הגרי"ז דהרמב"ם סובר דכל הנידון אי רב שמחל על כבודו כבורו מחול, הוי רק לענין חיוב הכבוד  שנוהג ברבו  מובהק , דאין זה מדין מצוה בעלמא רק יסודו הוא מדין חיוב שמחויב התלמיד לרבו, וע"ז הוא דשייך ענין מחילה,  אבל הדין הידור דנוהג בכל ת"ח , דביסודו הוי מצוה ככל מצות דעלמא, לא שייך מחילה ע"ז, דאין זה חיוב להת"ח , ולאו בדיריה תליא מילתא למחול ע"ז
ולפי"ז כתב דמדויק היטב מה שכתב הרמב"ם הרב ה"מובהק" שרצה למחול על כבודו, הרשות בידו.דדוקא ברבו מובהק, שיש בו דיני כבוד ומורא, דהוי חיוב לרבו, מהני מחילתו אבל ברבו שאינו מובהק , שאין בו דין כבוד ומורא, רק רין הידור הנאמר על כל ת"ח, לא מהני מחילה ע"ז וכמש"נ ע"ש.
ועכ"פ לפי"ז א"ש דאבדת חכם שאינו רבו אינה קודמת לאבדת אביו, כיון דלאביו הוי חיוב לאביו , משא"כ חכם הוי רק מצוה בעלמא, ודוקא ברבו מובהק דהוי ג"כ חיוב אליו [מדין כבוד ומורא שמחויב תלמיד לרבו] , בזה בעינן לטעמא דרכו קודם משום דמביאו לחיי העוה"ב

Rav Steinman is quoted in the A'aleh Be'Samar, page 174, as having discussed this.  He said over a story with the Beis Haleivi.  A shochet came with a shailah, and the Beis Halevi paskened it was treif, and the shochet got very angry and yelled at the Beis Halevi and used strong language against him.  The next day, an ox suddenly went crazy and killed him.  The Beis Halevi was very upset, because he was afraid the shochet was punished for his behavior toward the Rov, but Reb Chaim calmed him by saying that he himself heard his father say "I am mochel, I am mochel," so it wasn't his father's fault.

Rav Steinman asked, but if so, why did the shochet die the next day in such a shocking manner?  Wasn't it clear that his death was related to his chutzpah?  He answers, again, that for some things, mechilla does not help.  But, and this is important, he lessens the impact of this story by saying 

אלא דמכ"מ נראה שאם הקצב עצמו היה בא לבקש מחילה, יתכן דמהני, כיון שבא ונכנע לפני התלמיד חכם ומבקש מחילתו מתכפר לו.

But he then said that he saw the Turei Even that implies that even then the mechilla doesn't help.  Even so, in his Ayeles HaShachar by Miriam he says that he believes that when the rasha comes with contrition and asks for mechilla afterwards, that the mechilla does help:


החפץ חיים (הל׳ לה“ר כלל ח׳ סﬠיף א׳) כתב שאסור לספר לה׳׳ר אפי׳ ﬠל קרוב אף דרגילות הוא כמה פﬠמים שלא יקפיד האיש שנא' הגנות ﬠליו ﬠל המספר מצד אהבת הקורבה אשר ביניהם, ובבמ׳׳ח (אוח ב׳) כתב שזה נלמד ממﬠשה דמרים שמשה רבינו לא הקפיד כמ“ש והאיש משה ﬠניו מאד כמש"כ הרמב׳׳ם ואﬠפ"כ נﬠנשה מרים בצרﬠת.
והנה בברכות (י׳׳ט א׳) אמרינן אר׳׳י כל המספר אחרי המת כאלו מספר אחרי האבן, איכא דאמרי דלא ידﬠי ואיכא דאמרי דידﬠי ולא אכפת להו, ומשמﬠ שזה הטﬠם שאין איסור לדבר ﬠליהם לה׳׳ר, ולכאו׳ לדברי הח׳׳ח הנ"ל הרי יש איסור אפי' כשלא מקפיד ומה מוﬠיל שלא אכפת להם.
ובהמשך הגמ׳ שם איתא איני והאמר ר׳׳פ חד אישתﬠי מילתא בתרי' דמר שמואל ונפל ﬠליו קנה גדול וכבד, ומתרצת הגמ׳ שאני צורבא מרבנן דקוב׳׳ה תבﬠ ביקרי׳ ﬠי׳׳ש, ולפי׳׳ז אﬠ׳׳פ שהמת לא מרגיש או לא אכפת לו מ"מ הקב"ה תובﬠ ﬠל בזיון הת“ח.
ולפי"ז המדבר לשון הרﬠ ﬠל ת׳׳ח אפי׳ אם ימחל לו ויתכפר הלה׳׳ר מ“מ הקב׳׳ה תובﬠ את בזינו, ואפשר דכשבא לבקש מחילה מהת׳׳ח ומכניﬠ את ﬠצמו הרי זה מכפר גם ﬠל חלק זה, ויתכן שגם אם מרים היתה מבקשת מחילה ממשה היא לא היתה נﬠנשת בצרﬠת.


Along the same lines, Reb Meir Simcha says pshat in ארור מקלה אביו ואמו on Har Gerizim/Eival in Devarim 27:16 is that if a parent is mochel on his/her kavod, and the child slights them, he treats them with disdain, with Kalus, he is arur.  This is despite the mechila.
 שמקניט אביו ומצערו מפני שיודע שאביו ימחול לו שחש על עונשו של בן יותר מהבן לכן אררו ע״ז. ולכן לא שביק רב לבריה למשקל מניה סילוא דלמא חביל ביה (סנהדרין פ״ד) ולמחול ליה דקאי בארור


The Rivash mentioned in the Turei Even, and the Rambam, talk about the minhag to impose a penalty for bizayon of a talmid Chacham.  
Rivash:
והפיוס שצריך עם הארץ לפייס החכם הוא בשני פנים שיפייסיהו בדבריו לבקש ממנו מחילה ומטה(?) בכל מיני רצוי. וזולת זה חייב ליטול ליטרא זהב על כל פעם ופעם שביזהו ונותן אותה לחכם.... וקנס זה גובין אותה בכל מקום
(The discussion of the penalty actually was part of the shailah in the Rivash, but in the teshuva he agrees that it's pashut.)
Rambam TT 10:12
אע"פ שהמבזה את החכמים אין לו חלק לעוה"ב אם באו עדים שבזהו אפילו בדברים חייב נידוי ומנדין אותו בית דין ברבים וקונסין אותו ליטרא זהב בכל מקום ונותנין אותה לחכם.
Rambam Chovel uMazik 3:5
ואם בייש תלמיד חכם חייב לשלם לו בושת שלימה אע"פ שלא ביישו אלא בדברים כבר נפסק הדין שכל המבייש תלמיד חכם אפילו בדברים קונסין אותו וגובין ממנו משקל שלשים וחמשה דינר מן הזהב שהוא משקל תשע סלעים פחות רביע וקבלה היא בידינו שגובין קנס זה בכל מקום בין בארץ בין בחוצה לארץ: 

It's true that the Rama (YD 243:7) says that our Talmidei Chachamim are not on that madreiga and are not given a Litra of gold.


אין דין ת"ח בזמן הזה לענין שיתן לו המבייש ליטרא דדהבא (מהרי"ק שורש קס"ג ומהרי"ו סי' קס"ג) ומ"מ יקנסו הב"ד המבייש לפי המבייש והמתבייש (ריב"ש) ובלבד שלא יתחיל החכם במריבה לבזות בני אדם שלא כדין ויגרום בזה שיבזוהו ויתרסו נגדו (ג"ז שם) ומ"מ אף אם התחיל החכם קצת אין רשות לכל אדם להחציף נגדו לענות לו בעזות (הגהות מרדכי דקדושין) והכל לפי ראות הדיינים

But the Rama agrees that some kind of knas is imposed, even bazman hazeh.  If you want to cut corners and give less, then that aggravates your bizayon of the Talmid Chacham.

So, the answer to the question of the week is, probably not.  Maybe if the mechilla is in response to teshuva gemura and a personal apology, and, according to the Rambam and the Rivash, you have to pay the Chacham a Litra Zahav for every time you were mevazeh him.  But even then, if there's an element of chillul hashem, and there usually is, then good luck to you.

ועכשיו בזמנינו זה אין דנין דין זה לתלמיד חכם שיתן לו המבייש ליטרא דדהבא, מפני שצריך שגם התלמיד חכם יהא נוהג כשורה, הולך בנחת עם הבריות ומשאו ומתנו באמונה עמהם, אשר בעונותינו אין זה מצוי בינינו.

The Netziv I think says that the whole reason Hashem involved himself in the Miriam-Moshe issue is because Miriam's error in speaking against Moshe was not just a personal affront to Moshe, but struck at an issue fundamental to ikkarei emunah: the superiority of Moshe above all other nevi'im. Moshe's mechila can't undo a ta'us in ikakrei emumah.

To tell the truth, afar ani etc, but I don't necessarily agree with what Rav Steinman says, that if Miriam had asked mechila, she would not have gotten tzaraas, I would say like the Netziv that it was vital that Miriam's mistake have consequences, at least as a lesson to Klal Yisrael. I mainly wanted to get to the terrible mistake people make, that when gedolim argue that they think that once they take sides, then le'sheim shamayim they can talk with the worst azus panim against the other side, unlike David HaMelech, who spoke of Shaul with the greatest respect even as he was trying to kill him.

  2. Once you bring the Rema and the Levush, it takes all the wind out of your sails. The Levush, says that such talmidei chachamim בעונותינו אין זה מצוי בינינו. The Rema brings the same thing from RY Vayl, http://hebrewbooks.org/pdfpager.aspx?req=1746&st=&pgnum=116 and the Maharik, http://hebrewbooks.org/pdfpager.aspx?req=1142&pgnum=187 (it's really the exact same teshuva, and it was erroneously put into the Maharik) who says that our talmidei chachamim are not worthy of the title, and even if there are fine talmidei chachamim now, there are also some bad ones, so the whole halacha cannot be enforced. It looks to me like a wholesale hetter.

  3. I don't think the Mahari Weil meant that you can be someich on him to lechatchila be mevazeh a talmid chacham. There's always the possibility that the Ribono shel Olam will be makpid on his kavod and the kavod of His Torah, and the "yeish al mi lismoch" will be "מִשְׁעֶנֶת הַקָּנֶה הָרָצוּץ."
