Vayeishev, Breishis 37:25. Eating During Davening

For those that like to skip to the end of a teshuva, the answer is an unqualified Yes, a qualified Yes, and No.

****************

In our parsha, we are told that after they threw Yosef into a pit, the brothers sat and ate bread.  Before eating bread, they certainly made a bracha.  Of course, they also davened when it was time to daven. So our parsha involves the topics of Birkas HaNehenin and Tefilla.  With that in mind,......

When davening before the amud recently, we were worried about some minor coughing and hoarseness interfering with our davening.  Naturally, one would simply drink some water and continue.  Doing so during davening involves several interesting questions.

Of course, one might say that drinking plain water because of hoarseness or a cough does not necessitate a bracha at all.  That may be true, but it is also boring.  So let's say that you're really thirsty, and you will enjoy the water that you drink, or someone brings you sweet tea or a candy, so you would have to make a birkas hanehenin.

Before beginning, we want to point out that this issue is not simple to resolve.  Rav Ephraim Greenblatt says he just does not know.  See his Rivevos 6:29.  So if you feel you know the answer intuitively, it is not intuition, it is guessing.  As it turns out, we are mattir much more broadly than Rav Greenblatt, and it's not a guess.

Another important point.  We're discussing eating or drinking during tefilla.  This has nothing whatsoever to do with לא תאכלו על הדם or with  ואותי השלכת אחרי גויך in Brachos 10b.  We're talking where those issues are not applicable (e.g., OC 83:3.)

So there is a great deal to talk about.  Current likut sefarim bring down the opinions of many of our great contemporaries.  With all due respect, and in light of the fact that my chiyuv of talmud torah, unlike that of women, is not merely to know what to do, simply listing the opinions of Reb Chaim Kanievsky and Reb Nissim Karelitz and on and on would just be a sin, besides the fact that without seeing their reasoning in writing by their own hand or their own print, it's often either useless or misleading..  We am more interested in learning and discussing the sugya - with your help.

An important introduction to the concept of Hefsek.

There are two dinim in "Hefsek."  One is a halachic standard that establishes at what point does an Interruption cause Discontinuity, and the other is a halacha that Prohibits an Interruption that shows Disrespect.

The concept "hefsek" assumes a state of "Keviyus."  In other words, the yesod of hefsek is that it is interrupting or removing a keviyus. Here are two applications that illustrate the different kinds of hefsek.

                  1. Keviyus of a meal or achila.  When you make a bracha, you're koveya that the eating includes everything at that meal.  This is true for Shehakol and for HaMotzi.  HaMotzi has a greater keviyus and is harder to interrupt, but the idea is the same.  Hefsek interruption by achila involves  סילוק והיסח הדעת, distraction, or a diversion from the Keviyus.  This kind of hefsek has nothing to do with issur or hetter, it does not matter why you interrupted, whether it was an life emergency or a lark, whether it was to shmuess with someone or to go to a levayah.  If the diversion is of a nature that it breaks the keviyus, it is a hefsek.  (The phrase "סילוק והיסח הדעת" comes from the MB 178 sk 48.)

A similar din of hefsek is found by Birkos HaMitzvos: when you make a bracha on a ma'aseh mitzvah, such as kisui hadam, or bedikas chametz, and you begin to look for Chametz or you do one kisui, that bracha applies to subsequent kisuyim and bedikos, so long as there has not been a hefsek of  היסח הדעת.  Of course, what constitutes היסח הדעת depends on the degree of keviyus required.  (A yungermahn in our Kollel in Chicago, Rabbi Neuberger, suggested this distinction between nehenin and mitzvos, such that talking between drinks is not a problem while talking between mitzvos might be:  He said that food requires that you have made a bracha on achila, but it does not have to be a bracha on the food.  Mitzvos require that you have made a bracha on that mitzva. So for mitzvos, you are always in the condition of "between hamotzi and achila."  In our terminology, a greater keviyus is required between the Bracha and the ma'aseh mitzva.)

                  2.  Keviyus of tefilla.  This keviyus involves both an aspect that is the same as the keviyus of achila and an additional aspect of issur. Where do we find, in Tefilla, the concept of hefsek of סילוק?  We find it by the din of See, e.g., MB 104 sk 16.  The other din, that is unique to Tefilla, is the din issur.  Keviyus of tefilla means that you are not allowed to interrupt because of the importance of making the tefilla a tefilla kevu'ah, not ara'i.  So while the keviyus of a "break" is similar to the idea of היסח הדעת as achila, the idea of hefsek as an איסור which relates to the importance of tefilla kevu'ah will depend on the  חומר of that particular tefilla, and the need for the interruption.  If it's a זלזול, then it's called a hefskek and it is אסור.  Therefore we find that it might be muttar to respond to one person's greeting, but assur to respond to another's.

Having said that issur or hetter of Hefsek in tefilla depends on the requirement of keviyus of that part of tefilla and the justification for the interruption, our questions might have different answers for different parts of tefilla, such as Bein HaPrakim and B'emtza Perek and in middle of Shemoneh Esrei.  But, you say, who would think you can eat in middle of Shemoneh Esrei!  You are standing lifnei haMelech!  The answer is that a diabetic that must eat something in middle of davening, will obviously do so.  But may he eat without a bracha?  If he can eat, maybe he must make a bracha!  After all, the Bracha is a mattir; eating without a bracha is like gezel (Brachos 35a, beginning of Keizad Mevarchim,)  As we will see, there is good reason to be mattir even for non-life-threatening situations.

Here are the general questions.

1.  First of all, is one allowed to eat or drink during davening?  Perhaps the act of eating during tefilla is a hefsek.  Just because tefilla is not a hefsek during a meal (OC 178:6) does not prove that eating is not a hefsek during davening. (During eating, unrelated speech is not a hefsek, so tefilla is not a hefsek.  But during tefilla, when unrelated speech is a hefsek, perhaps eating is a hefsek too.)  On the other hand, it might not be different that any other bodily need that does not contradict the kedusha of tefilla, such as breathing or coughing.

2. Let us assume that eating is not, or is sometimes not, a hefsek, so there are times that you can drink during davening.  I assume that the best thing would be to prepare for this eventuality by making a bracha on something before beginning to daven.  But if he did not, and then he needs to eat or drink, may one- must one- make a bracha in middle of davening, or would the bracha be a hefsek?

3. And if the bracha is a hefsek, may he or she eat without making a bracha, or would the impossibility to make a bracha result in an issur to eat?

Of course, the answer will depend on the circumstances.

1. Medical emergency.  Where he has to eat, such as a diabetic, and he eats a fruit or a candy that requires a bracha. Obviously, he can eat.  Does he make a bracha?
2. Pressing physical need in order to continue davening properly.  Where he wants to eat because he is coughing, or he is in pain, and this makes tefilla difficult, especially where he is davening for the amud.  Here, both questions apply.  Can he eat in middle of tefilla?  If he does, should he make a bracha?
3. To prevent discomfort and to improve the quality of his davening.  He can muddle through davening even if he does not eat or drink.  But he wants to eat so his throat won't bother him or so he can daven with a clear voice. Again, both questions apply.  Can he eat in middle of tefilla?  If he does, should he make a bracha?

Relevant sugyos:
Brachos 40a, that something that is necessary for what you're doing is not called a hefsek.
and OC 167, MA OC 66 sk 4 etc.
Rav says it's not a hefsek when your dibbur is necessary for the Bracha. Rav Yochanan adds even when it is necessary for the food that you're about to eat.  Rav Sheishes says, even if it is only tangentially related to your meal, such as the need to feed your animals before you eat.
The Magen Avraham in 236 sk 1 says the same applies to Tefilla.

OC 66:3, what to do if you hear kaddish or kedusha during davening, and responding to someone whom you fear or respect.
and Magen Avraham 66 sk 5, that one may interrupt tefilla for the bracha on thunder.
Aruch Hashulchan 66:6-

The Taz in OC 62 sk 1 that says that if you drink at night, you don't have to drag yourself out of bed, just have kavana for she'hakol in your mind. However, the Aruch HaShulchan, in his attempt to simplify the Taz, complicates it.

On the other hand, the MB 62 sk 9 and 84 sk 7 says that an oneis that makes bracha impossible does not mean that you can eat without a bracha, it means that you can't eat.  In the Biyur in 62 he explains that a bracha is not just a mitzva, which would mean that where you cannot do the mitzva it does not pertain, but it is also a mattir.  AND, he says, it's not really an oneis, because you have the option of walking into to the next room, making a bracha and drinking, and then continuing to drink in the room where you can't make the bracha.  The point is that he emphasizes the "Mattir" and "Gzeila" aspect of birkas hanehenin.  But I believe that he only means it where it''s not really an oneis.

The petur of an onein from birkos hanehenin is Oseik Be'Mitzvah/Tirda.  Obviously, we don't say the onein shouldn't eat, or should minimize his eating, because that would negatively affect his ability to do what the mitzvah he needs to do.  This might apply to someone who is in middle of davening.  But, again, if there's a Mattir aspect, Oseik would not help.

Brachos 16b, laborers that eat during work should not make a bracha on their food, according to the girsa of Rashi and Tosfos, or that they do have to make a bracha, according to the girsa of the Rif and the Geonim. But the Rosh and Tosfos are goreis the opposite, that laborers are obligated to make the birkas hanehenin, and the shittah of the Rif/Geonim is not brought down in OC.

As a general matter, besides the Gemara about gozeil in Keitzad Mevorchim, it's worth pointing out the Pnei Yehoshua I heard from R Chaim Brown that Bracha Rishona is Deoraysa, although the form of the Bracha is not. Here's the Pnei Yehoshua, from the beginning of Keitzad Mevorchin.
Which, to me, means that the mitzva aspect is Deoraysa, but the "Gezel" aspect is derabanan, and only applies when the mitzvah aspect applies.  Also, it means to me that you can be yotzei the deoraysa with hirhur, as from the Taz in #3.  Which is close to something R Nissim Kaplan said in 1984.  Reb Shlomo Zalman also says this in his Halichos Shlomo.

The great kula of the Chayei Adam:
Here's what someone wrote about this: Basically, he says that the Emek Bracha argues with the Chayei Adam, because according to Reb Chaim's pshat in tefilla, it doesn't matter why you went to the seforim shank to look up a shaileh, you're not standing lifnei hamelech.  He, this author, says it's odd to argue with the Chayei Adam based on Reb Chaim, when both the Mishna Berura and the Chazon Ish disagree with Reb Chaim.

And along these lines, and very relevant to this discussion, see Igros OC 4:16.
I say it that the Chayei Adam and Reb Moshe are important because some of our questions deal with tzorech tefilla, to some extent- hoarseness that interferes with his davening for himself or at the amud.

Here is a brief outline of Reb Moshe's teshuva.
Reb Ephraim Greenblatt asked him whether it's muttar to be mafsik for the sake of other people's tefilla in those places where you're allowed to be mafsik for your own tefilla's sake.  In Rav Greenblatt's shailah, he indicates that he holds that for your own need of tefilla, you can be mafsik in middle of shemoneh esrei.  On that, Reb Moshe says two things.  First, that between the brachos of shemoneh esrei, no hefsek is allowed except for pikuach nefesh.  But, importantly, he says there is a machlokes whether tzorech tefilla is called a hefsek that is muttar, or that it is not a hefsek at all.  For example, he brings the Magen Avraham in 236 sk 1 that says that tzorech tefilla is like havei melech, which is not a hefsek at all, and he holds not like the Maharshal who is only mattir by maariv because it's a reshus- because, apparently, the Mahrshal holds it's a hefsek which needs a hetter.

Most importantly, Reb Moshe says that this is a machlokes betgween the Rambam (and the Rashba) and Tosfos.  Tosfos Brachos 40a holds that the hetter to talk the bracha and achila is only muttar if it's directly relevant to the bracha of hamotzi, i.e., melach.  But the Rambam holds that anything having to do with the meal is muttar, and that is because tzorech achila is not a hefsek at all.

So according to Reb Moshe's Rambam/Rashba, tzorech tefilla, like drinking because he's hoarse, is not a hefsek at all, and would be muttar in middle of Shemoneh Esrei between brachos.  According to Tosfos, it would be assur during Shmoneh esrei.

Also, Reb Moshe says that even the Rambam would not be mattir in middle of a bracha in Shemoneh Esrei, because  that is a hefsek in all cases "כיון שמקלקל הברכה".  Even if צורך תפילה לא הוי הפסק כלל, being mekalkeil a bracha is inherently a hefsek.

So, here's what I think.

It is muttar to drink during davening when it enhances your tefilla.  Doing so to enhance  your tefilla is neither  סילוק והיסח הדעת nor is it by any means  זלזול תפילה. This is certainly muttar bein haprakim, and I think it's muttar even be'emtza perek.

When you eat or drink during davening, you can make a regular bracha.
However, during Shemoneh Esrei, although you can eat, if necessary, you should eat between brachos, and not during a bracha.  If you do eat during a bracha in Shemoneh Esrei, you should make the bracha in your heart, not verbally.

I would have considered being mattir drinking and making a bracha between brachos during Shemoneh Esrei, because this has support from the Chayei Adam and Reb Moshe and the excellent svara of Tzorech, But I have a problem with the pashtus of the Gemara  in Brachos 21b
To me, לכל אין מפסיקין is mashma לכל, which is an absolute.  So during Shemoneh Esrei it's better to do like the Taz and make the bracha in your heart.

In additional support of my opinion,

1.  Aruch Hshulchn 66:5

True, they are talking about bein haprakim of Krias Shma.  But I say that the tzorech of water to enable you to daven properly is a bigger tzorech and less of a hefsek, and would be muttar even b'emtza perek, and even between brachos in Shemoneh Esrei.

2.  If brand names will make you happier, here's what a likkut sefer, Mareh Davar 4, Avraham Hart, Bnei Brak tof shin ayin, has to say about this.

3.  The Bechor Shor argues on the Magen Avraham that we brought who allows saying the Bracha on thunder bein haprakim.  But you should know that the reason the Bechor Shor argues is that you can't prove birkos shevach from the hetter to answer Kaddish and Kedusha; you're busy saying one shevach, you shouldn't interrupt with a different shevach.  Only Kaddish and Kedusha, where not saying it is disrespectful, is muttar.  It is pashut that the Bechor Shor would agree that saying Birkas HaNehenin would be muttar, because unlike Re'eimim, which is just Shevach, Nehenin is more similar to Kaddish and Kedusha, due to the svaros in Brachos 35, as I mentioned above.  Whether nehenin is a mitzva or a mattir, it is not just shevach.

Aruch Hshlchn 66:6

4.  Above, we brought down the Magen Avraham OC 66 sk 4 about the bracha on a tallis in middle of davenning.  The Mishna Berura, (66 sk 16) in discussing this, says an interesting thing.  He says that Tefillin you can put on and make a bracha, but a tallis, better to put it on but make the bracha afterwards. So if he's embarrassed, he definitely can put on the tallis and make a bracha bein haprakim.  So you see that once you are embarrassed, it becomes a צורך תפילה, and that enables you to make a bracha on it.
