And the shito of Tosfos that they you make 2 berachos? I am trying to help a friend with his son's Bar Mitzvah speech but unfortunately I am just a regular guy and do not know where to look. If someone knows a sefer that has a piece on this that is understandable and logical, I would be very appreciative. I am also trying to work out how the machlokes fits in with what the possuk says the taam of the mitzva is about lemaan tihiye toras Hashem beficha. Apologies again for asking but I would be really grateful for any help. I'm not following your ...Thank you for writing. I'm not following your he'ara. Hagbala was hora'as sha'a, but it certainly wasn't that of a navi. Besides pesukim, the Gemara in Shabbos on 86b states clearly that whether on the third of the fourth, it was a tzivui from Hashem. Sure, it's not le'doros, but it wasn't Moshe's idea. <br />I know my mention of Hagbala is not clear. I mention it for two reasons. First, because it seems to me that there's a din of yamus and a din of sakol yisakel. The former was a metziyus, and applied only during Mattan Torah. The latter is a punishment, and applied all three days. Second, because in Shemos 19:21 it says פן יהרסו אל ה׳ לראות ונפל ממנו רב, which to me implies that touching the mountain was only a problem because they would run up to the top, so it was a hagdara. Not sure that in that context the concept of harchaka vs. inherent issur has the same significance. (For that matter, what would have happened had they broken through and stepped on Har Sinai?
