Vayikra. Mikem; זבח רשעים תועבה

A Jew that is a Rasha is not allowed to bring a korban. A Rasha, a Mumar lechol haTorah kullah, is not allowed to bring a korban, even if he believes in the kapara of the korban and he wants kapara.  This is not because a korban is only mechapeir for a shogeig, and the refusal to do teshuva turns the shogeig into a meizid, because as Reb Elchonon says (Kovetz He'aros, old 563, new Yevamos 7:13) if that were true, it should not apply to those korbanos that can be brought for a meizid.  Instead, it is a Gzeiras Hakasuv that זבח רשעים תועבה.  Therefore, a person that is not aware of an aveira and that's why he doesn't do teshuva, that doesn't make him a rasha, and his korban is fine.


Deciding who is a rasha would be a problem, but I think that not only would the Zalmans allow the Aarons, they might even allow Lubavitchers to be makriv.  Or maybe not.  I would not be comfortable with extremist maniacs waving chalifs around and fighting about who is and who is not an yimach shemo-nik apikores.  But we don't have to deal with this practical application presently, because, economically, that very problem has resulted in our not having a Beis HaMikdash at all.  Furthermore, this has no current application regarding Tefilla.  Nobody in history ever prohibited a mumar from saying shemoeh esrei.  So we will discuss this only in theory. 


This din To'eiva is applied to the korbanos found in an Ir Hanidachas.  In Sanhedrin 112b, Reb Yochanan says all korbanos found in an Ir Hanidachas are destroyed because they are  זבח רשעים תועבה. Reish Lakish says no problem, just wait till they get a mum and redeem them and use the money to buy new Korbanos.  ירעו עד שיסתאבו וימכרו ויביא בדמיהם עולות.  What does RL do with זבח רשעים תועבה? He holds that only applies b'ein, not if they are nifdeh, but RY holds the psul sticks, and shinui does not lift it.

What is the basis of the machlokes Reb Yochanan and Reish Lakish?

Another question- if a rasha does bring a korban, and you find out in middle, do you continue the avoda when you find out, or should you burn it?  And if a rasha does bring a korban, and the avoda is done correctly from beginning to end, later when he does teshuva, does he have to bring another one?  The Rambam says that a person that is meva'eit in the kapara, who rejects the kapara of the korban, does have to bring another one, but meva'eit is not the same as זבח רשעים תועבה.  Additionally, that Rambam implies that the Korban is kasher- he says (Shegagos 3:11)
אין יום הכפורים ולא החטאת ולא האשם מכפרין אלא על השבים המאמינים בכפרתן. אבל המבעט בהן אינן מכפרין בו. כיצד היה מבעט והביא חטאתו או אשמו והוא אומר או מחשב בלבו שאין אלו מכפרין אע"פ שקרבו כמצותן לא נתכפר לו וכשיחזור בתשובה מבעיטתו צריך להביא חטאתו ואשמו. וכן המבעט ביום הכפורים אין יום הכפורים מכפר עליו. לפיכך אם נתחייב באשם תלוי ועבר עליו יום הכפורים והוא מבעט בו הרי זה לא נתכפר לו וכשיחזור בתשובה אחר יום הכפורים חייב להביא כל אשם תלוי שהיה חייב בו:
To me, that's pretty clear- by me'va'eit, he has to bring another one, which may or may not be true by a regular zevach resha'im, but even by me'va'eit nowhere does he say that the original korban is passul.  It's kasher, but it's not mechapeir, like every shinui ba'alim or shinui kodesh.


On the other hand, Tosfos in Chulin 5b asks, why do you need a passuk for lo shov midiaso when it's already excluded under ZRT.  Tosfos answers that under ZRT, later when he does Teshuva he can bring the korban, but if he's ESM, he can never bring a korban for that sin.
אינו שב מידיעתו אינו מביא קרבן על שגגתו. תימה מה צריך קרא למעט לאינו שב מידיעתו ועומד ברשעו הא הוי זבח רשעים והיכי תיסק אדעתין לומר דמביא ויש לומר דאיצטריך להיכא דחזר בתשובה אח"כ ובשעה שאכל לא היה שב מידיעתו:
Obviously, Tosfos holds that as far as degree of psul, they are identical.  And we know that in the case of ESM, it is 100% passul, it's bichlal not a Chatas.  This clearly indicates that Tosfos holds, unlike the diyuk in the Ramban, that ZRT is a psul gamur.


Reb Moshe in the Dibros in Chulin 5b klers whether the din זבח רשעים תועבה means that it's assur to be mekabel from a rasha, or is it a psul in the korban.
 דאינו דין בהקרבן אלא שהוא דין בהקבלה מהאדם להקריב לגבוה, שהקפידה תורה בקרבנות לא רק על הקרבן בדיניו שקבעה תורה איך יהיה אלא גם על בעל הקרבן איך יהיה שלא יקבלו מרשע
or 
 דהוא חדוש דין בהקרבן שבלא כפרה ורצוי לא שייך להחשיבו קרבן ולהקריבו, ואף בקרבנות נדבה שהם דורון צריך עכ״פ שיתכפר לו בהדורון שהביא,

We propose that the machlokes RY and Rl is talui in the two tzdadim in the Dibros.  Additionally, we suggest that the issue of whether the korban is passul also depends on the two tzedadim.


B'derech drush, the idea of זבח רשעים תועבה sounds like אין דבר שבקדושה פחות מעשרה, that unless you're ra'ui, you are not allowed to do a davar shebikdusha.  Additionally, one. might also say that the problem is that you are using korbanos in the service of your rish'us- why are you bringing the korban?  Because you're a rasha and your conscience bothers you a little.  To quiet your conscience, you bring a korban, and this helps you do your aveiros without any inhibition.  So by other mitzvos, like if you give tzedaka for that reason, its a chutzpah.  By a korban, which has kedusha, it's not just a chutzpah, it's like using a sefer torah as a step-stool. The avlah of using a davar shebikdusha to help you do aveiros is a to'eiva. 

As my cousin Jordan Jay Hillman used to say, the Torah does not allow a person to purchase a clean conscience.  

Note: Jordan was a secular Humanist, but he had a beautiful neshama. I realize that it's ironic to mention him in this particular post, but there it is.


In the end, it is good to remember that when the Nevi'im warned Klal Yisrael about the Churban and Galus, one theme was repeated- the Nevi'im identified two things people did that they claimed to be mitzvos but were disdained by the Ribono shel Olam, and those are Taaneisim but mostly the Korbanos.  Read what the Navi says about the korbanos- and ends by saying "Did I (Hashem) ask your forefathers for korbanos when I took them out of Mitzrayim?  All I asked is that they listen to My voice and go in My path."  The navi is emphasizing that Korbanos are not automatically a zechus.  When they are brought for the right reason, they are wonderful.  When they are not, they are a to'eiva.

יח  כִּי לֹא תַחְפֹּץ זֶבַח וְאֶתֵּנָה עוֹלָה לֹא תִרְצֶה. יט  זִבְחֵי אֱלֹהִים רוּחַ נִשְׁבָּרָה:לֵב נִשְׁבָּר וְנִדְכֶּה אֱלֹהִים לֹא תִבְזֶה.

The Neviim are not saying that Hashem doesn't want your tefillin or your arba kosos.  Again and again and again they talk about korbanos.  Korbanos without the right kavana are not like any other mitzva done shelo lishma.  They are abominations.
