Questions for Ki Seitzei 2026

Our Parsha Questions are crafted to be challenging even to Talmidei Chachamim but answerable by anyone who pays careful attention to the Krias HaTorah. I  saw this practiced in Marlboro, NJ. I find that it increases attention to Krias HaTorah and is mentally stimulating both for the audience and for me.  They are meant to be presented before Krias HaTorah and answered afterwards, giving everyone the chance to show the answer chapter and verse. I usually include some that are simple so that everyone can participate.


1.  When Hagar and Yishmael were evicted from their home, Hashem was about to reveal water to Hagar so that Yishmael should not die of thirst. The malachim said, Ribono shel Olam, this person, Yishmael, will bring such death and suffering to your people, and you are saving him? Hashem answered that He judges him באשר הוא שם, as he is now, not what he will be in the future. We mention this on Yom Kippur as well, and ask that Hashem judge us as we are right now when we are doing teshuva- not as we were, and not as we might be in the future. In this parsha we see the opposite. Where do we see this, and how would you distinguish between the two. 

2. The word קדש means holy. We say נקדש את שמך בעולם, and אשר קדשנו במצוותיו, and אין דבר שבקדושה בפחות מעשרה. In this parsha, find this word used once in its usual sense, and twice meaning the exact opposite. 

3. The issur of certain people to marry a ישראל כשר; is that because the marriage is an offense against the kedusha of that individual or because it is a sin against the kedusha of the nation as a whole.

4.  Simlah is not gender specific. Examples:  ואהב גר לתת לו לחם ושמלה   and  שמלתך לא בלתה מעליך ורגלך לא בצקה.  So why in 24:5 does it say לא יהיה כלי גבר על אשה ולא ילבש גבר שמלת אשה, a woman should not carry a man’s kli and a man should not wear a woman’s simlah? Aren’t they both words for clothing?

5.  Which unique mitzva is only rewarded if it happened by accident?

6.  In this parsha, four mitzvos of memory. . In two, remembering is a mitzva.   In one, not remembering is a mitzva. In another, remembering is a mitzva and forgetting is a lo saaseh.

7.  What type of object may one not take as collateral?

8.  Two neviim mentioned in the Parsha, a man and a woman.

9.  Three examples of the Torah’s discouragement of the mistreatment of animals, צער בעלי חיים.

10.  Three halachos mentioned in our Parsah that occur at sunset or nightfall.

11.  The Shu”t Divrei Malkiel from the Lomzer Rov and others write that calling a child a name which is used by the opposite gender (like naming a boy 'Sue,') violates the prohibition (22:5) of lo yilbash. Rav Chaim Kanievsky lists 79 names in Chazal and Tanach which are used for both men and women. (The ones who asser, I assume, are talking about cases where the name is used exclusively for one gender.) How many can you identify that are currently used for both genders? (Taima D’Kra)

12.  22:19 seems to mean that a woman can be married to a man who tried to have her murdered. 

וענשו אתו מאה כסף ונתנו לאבי הנערה כי הוציא שם רע על בתולת ישראל ולו תהיה לאשה לא יוכל לשלחה כל ימיו

Is this really true?

13.  What is the military consequence of indecency, pritzus.

14.  A part of the body that is mentioned or even referred to only one time in Tanach, in our parsha.

15.  It is very important to pay attention to the Krias HaTorah. Why would the Irish Rebellion and the troubles that followed have never occurred if only Henry the Eighth had paid attention to the Krias Hatorah of Parshas Ki Seitzei.

16. How many mitzvos are there in the Parsha of Amaleik.

17. There's a common linguistic phenomenon called 'metathesis' or 'שיכול אותיות'.  This is when the letters in a word are exchanged. In English, you have ask/aks, nuclear/nucular, jewelry/jewlery. In Lashon HaKodesh, you have keves/kesev. (Which the Ramban says are the same. Some, like the Baal HaTurim and the Malbim, say they are slightly different, but they are still almost synonymous.) Find two words in the parsha that illustrate this.

Ben Sorer Umoreh, who is executed not for anything he has done, but for the crimes his inexorable trajectory will lead to. 

Why are they different? In my experience, people prefer explanations they come up with, and just don't like explanations they are told. So you're on your own. I and my mother זכרונה לברכה preferred the Mizrachi's explanation with a very important modification. Baasher hu sham is only for the בית דין של מעלה PLUS tefilla, Hagar's tears. Without my mother’s addition, just to say “Beis Din shel Maalah is different” seems farkert from seichel hayashar.

It's a harsh thing to say, but the mussardikkeh way to say it is "Without tears, the judgement on Yom Kippur will not be באשר הוא שם."

22:9 

לֹא תִזְרַע כַּרְמְךָ כִּלְאָיִם פֶּן־תִּקְדַּשׁ הַמְלֵאָה הַזֶּרַע אֲשֶׁר תִּזְרָע וּתְבוּאַת הַכָּרֶם׃ 

23:18

לֹא תִהְיֶה קְדֵשָׁה מִבְּנוֹת יִשְׂרָאֵל וְלֹא יִהְיֶה קָדֵשׁ מִבְּנֵי יִשְׂרָאֵל׃

As Rashi says in 22:9, the word kodesh essentially means "designated for a use that renders it untouchable."

3. The issur of certain people to marry a ישראל כשר; is that because the marriage is an offense against the kedusha of that individual or because it is a sin against the kedusha of the nation as a whole.

It is because of the sin against the nation as a whole. Six times the Torah uses the expression "בקהל השם", and they are all here by issurei kiddushin. 

Even if you did not have the passuk, it would be obvious that it is not to protect the kedusha of the yachid, because the issur is only on marriage, not simply living together. Marriage is an issue that relates to Klal Yisrael, not just individuals. That's why the Mishna in Megilla includes Birkas Chasanim among דברים שבקדושה. 

This (except the sentence about davar shebikdusha) is based on Reb Yaakov's Emes L'Yaakov on 23:3, where he says 

ובהכרח שענין הנישואין אצל בני ישראל אינו ענין פרטי הנוגע לשני הצדדים ומשפחתם בלבד, אלא הוא נוגע לקהל כולו, שעל ידי נישואין נכנס הבחור לקהל ישראל ונהיה חלק מהציבור.

4.  Simlah is not gender specific. Examples:  ואהב גר לתת לו לחם ושמלה   and  שמלתך לא בלתה מעליך ורגלך לא בצקה.  So why in 24:5 does it say לא יהיה כלי גבר על אשה ולא ילבש גבר שמלת אשה, a woman should not carry a man’s kli and a man should not wear a woman’s simlah? Aren’t they both words for clothing?

Because men often carry or  wear non-clothing items that are associated with men only, such as a sword. Such items that are associated exclusively with women are carried in equal part for their decorative qualities, such as a purse, or a wrist watch, which includes them in in Simlah. (In other words, a woman will carry an empty purse and a wrist watch that is not working.) (Taama diKra) I have to think about מחט נקובה in במה אשה. 

There are some who believe that wearing a tie is a problem for a man, because it is only decorative and non-functional. Some argue on the basis of the reference to men wearing earrings in the story of the Eigel:  Shemos 32:2-3,

וַיֹּאמֶר אֲלֵהֶם אַהֲרֹן פָּרְקוּ נִזְמֵי הַזָּהָב אֲשֶׁר בְּאׇזְנֵי נְשֵׁיכֶם בְּנֵיכֶם וּבְנֹתֵיכֶם וְהָבִיאוּ אֵלָי׃

וַיִּתְפָּרְקוּ כׇּל־הָעָם אֶת־נִזְמֵי הַזָּהָב אֲשֶׁר בְּאׇזְנֵיהֶם וַיָּבִיאוּ אֶל־אַהֲרֹן׃.

But the ibn Ezra there says this was a habit some picked up in Mitzrayim, not a Jewish behavior:

ויאמר פרקו. על משקל ברכו מהבנין הכבד הדגוש. מנהג מצרים היה לשום נזמים באזניהם. וככה כתוב במדינים כי ישמעאלים הם

and the Radal in Pirkei d'Rebbi Eliezer, where the Mishna (45:5) says 
רָאוּ הָאֲנָשִׁים שֶׁלֹּא קִבְּלוּ הַנָּשִׁים לִיתֵּן אֶת נִזְמֵיהֶן לְבַעֲלֵיהֶן, וְעַד אוֹתָהּ שָׁעָה הָיוּ הַנְּזָמִים בְּאָזְנֵיהֶם כְּמַעֲשֵׂה הַמִּצְרִיִּים וּכְמַעֲשֵׂה הָעֲרָבִים, וּפָרְקוּ אֶת נִזְמֵיהֶם שֶׁבְּאָזְנֵיהֶם
says (45:23)
 כמעשה המצרים וכמעשה הערביים. ר"ל שהן קיבלו מנהג זה מן המצריים שהיו נוהגים כערביים שהן הישמעאלים שכתוב עליהן במקרא [שופטים ח] כי נזמי זהב להם כי ישמעאלים הם (אבל בשאר כל האומות אין נוהגים האנשים לשום נזמים באזניהם רק הנשים,

 

5.  Which unique mitzva is only rewarded if it happened by accident?

שכחה.    Rashi says this clearly here: 24:19

למען יברכך. וְאַעַ"פִּ שֶׁבָּאת לְיָדוֹ שֶׁלֹּא בְמִתְכַּוֵּן, קַ"וָ לָעוֹשֶׂה בְמִתְכַּוֵּן. אֱמֹר מֵעַתָּה נָפְלָה סֶלַע מִיָּדוֹ וּמְצָאָהּ עָנִי וְנִתְפַּרְנֵס בָּהּ — הֲרֵי הוּא מִתְבָּרֵךְ עָלֶיהָ (ספרי):

Some argue and say that the mitzva is really to leave it there after you remember. But that is not true. It says

כִּי תִקְצֹר קְצִירְךָ בְשָׂדֶךָ וְשָׁכַחְתָּ עֹמֶר בַּשָּׂדֶה לֹא תָשׁוּב לְקַחְתּוֹ לַגֵּר לַיָּתוֹם וְלָאַלְמָנָה יִהְיֶה לְמַעַן יְבָרֶכְךָ ה' אֱלֹהֶיךָ בְּכֹל מַעֲשֵׂה יָדֶיךָ

As soon as you forgot it, it becomes the property of the poor. Not going back and stealing it is no reason for a bracha. It must be that the bracha and the mitzva is for forgetting it. (Reb Yaakov.)

Also, this is clear in many meforshim, such as the Mizrachi here and the Gur Aryeh. Additional examples:

Aruch Hashulchan Ha'asid Hilchos Peah 9:1

ומשונה מצוה זו מכל מצות שבתורה שכל מצות שבתורה אין באים אלא על ידי זכירה כדכתיב וזכרתם את כל מצות ד' ועשיתם אותם ואם נשכח לא נעשה המצוה ומצוה זו היא להיפך שא"א לקיים המצוה רק ע"י שכחה והקב"ה זיכהו במצוה זו

Tosefta Peiah 3:13

מעשה בחסיד אחד ששכח עומר בתוך שדהו, ואמר לבנו צא והקריב עלי פר לעולה ופר לשלמים. אמר לו אבא מה ראית לשמוח בשמחת מצוה זו [יותר] מכל מצות שבתורה? אמר לו כל מצות שבתורה נתן [להם המקום] לדעתנו, זו שלא לדעתנו. שאילו [עשינוהו ברצון לפני המקום לא באת מצוה זו לידינו. [אלא] הרי הוא אומר (דברים כד) כי תקצור וגו' קבע לו הכתוב ברכה. והלא דברים קל וחומר, מה אדם שלא נתכוין לזכות וזכה מעלין עליו כאילו זכה, המתכוין לזכות וזכה על אחת כו"כ.

 7.  What type of object may one not take as collateral?

People think that 24:6 לֹא יַחֲבֹל רֵחַיִם וָרָכֶב כִּי נֶפֶשׁ הוּא חֹבֵל prohibits taking any utensils used in food preparation as collateral. According to all but one Rishon, this is only when the loan is past due and you are seizing his property to press him to pay the debt.   But when he is first asking to borrow money, he can collateralize whatever he wants. If he can sell his pots and pans, he also can use them as a mashkon.   The one and only Rishon that says it applies even when the loan is made is the Rambam in Malveh v'Loveh 3.  

The same is true in the case of בגד אלמנה in 24:17. See CM 97:14.

וּכְבֹא הַשֶּׁמֶשׁ יָבֹא אֶל־תּוֹךְ הַמַּחֲנֶה׃

24:13, you have to return to the borrower his clothing you took as collateral. (Shkiyah.)
הָשֵׁב תָּשִׁיב לוֹ אֶת־הַעֲבוֹט כְּבוֹא הַשֶּׁמֶשׁ 

24:15, you have to have paid your laborer his day’s wages (CM 339:3.) (Shkiyah.)

בְּיוֹמוֹ תִתֵּן שְׂכָרוֹ וְלֹא־תָבוֹא עָלָיו הַשֶּׁמֶשׁ

21:23, לֹא תָלִין נִבְלָתוֹ עַל הָעֵץ כִּי קָבוֹר תִּקְבְּרֶנּוּ בַּיּוֹם הַהוּא, sounds like it might be another. But the Poskim say it is only to leave the body unburied all night. There's a difference between כבוא השמש and לא ילין. See Pischei Teshuva YD 357:1 from the Radvaz-

 בתשו' רדב"ז החדשות סי' שי"א שכתב דדוקא אם מלין את מתו כל הלילה עד הבוקר עובר בלאו אבל מקצת הלילה אינו עובר ואפילו איסורא ליכא אלא כדי להיות משובח יש למהר להוציא מתו כדלקמן סעיף ב' ע"ש

Yonah, Simcha, Zissel, Shimmy, Yoel, Michal, Micha, Seruya, Ariel/Arielle.

Is this really true?

No. אין אדם דר עם נחש בכפיפה אחת.   My assumption is that he, contemplating a miserable and expensive future, will pay her to accept a get- the present value of everything he'll have to spend to keep her, plus the benefit of not having her sneering at him and poisoning his home atmosphere for his whole life.

צפרנים

21:12

 וְגִלְּחָה אֶת רֹאשָׁהּ וְעָשְׂתָה אֶת צִפׇּרְנֶיהָ.

It does say צפורן שמיר  in Yirmiahu 17:1,  חטאת יהודה כתובה בעט ברזל בצפרן שמיר חרושה על לוח לבם ולקרנות מזבחותיכם, but it doesn’t mean fingernail there. It means a sharp pointed inscribing instrument, like hammer and nails. So the צפרנים  in our parsha still counts as a one time word.


15.  It is very important to pay attention to the Krias HaTorah. Why would the Irish Rebellion and the troubles that followed have never occurred if only Henry the Eighth had paid attention to the Krias Hatorah of Parshas Ki Seitzei.

Henry wanted to marry his brother, Arthur's, widow, Catherine of Aragon, in 1509, but was told he could not because she had been married to his brother. They accepted the issur of a woman once married to a brother, but did not accept the mitzvah of Yibum that we find in this week's parsha. So he called up the Pope, and said "Pope, can you annul Catherine's marriage to Arthur? It was never consummated." And the Pope said, "ok, fine, I'll grant a dispensation."  Henry married her. Catherine didn't have male children and he wanted to get rid of her and formalize his relationship with his mistress, Anne Boleyn. The problem was that the Church did not allow divorce at all, even though it's in this week's parsha. He called the Pope again. He said "Good Yontif, Pontif. It's Henry. I'd like for you to annul the marriage to Catherine." The Pope said, "What are you talking about? I did that like twenty five years ago!" Henry said, "No, I mean the marriage between me and her."   The Pope said, "What, this also wasn't consummated? So where did Bloody Mary come from? Stop bothering me. No more dispensations, and forget about any annulments." So Henry went and created the Anglican church, his Archbishop annulled their marriage, and he married his paramour, Anne Boleyn. (This marriage was also sub-optimal.)

England became Anglican, Ireland remained Catholic, the Anglicans treated the Irish Catholics terribly, and this all led to the Irish Rebellion of 1798 and the endless trouble that followed.

The point is, that if had done Yibum, he could have had Katherine without calling the Pope, and when he wanted to move on to Anne Boleyn, he could have simply divorced Katherine.  There would have been no need to found the Anglican Church.  From here we see that it is important to pay attention to the Krias HaTorah.

16. How many mitzvos are there in the Parsha of Amaleik.

According to the Rambam, three. Zachor, Timcheh, and Lo Sishkoch. Also according to the Ramban and the Smag and the Sefer HaChinuch

Zachor- To read the parsha once a year.

Timcheh- To destroy.

Lo Sishkoch- To never forgive, not to let the passage of time weaken our wrath for their atrocities. 

Rav Saadiah Gaon and the Bahag only count #1. See Rav Yerucham Fishel P for his discussion, especially the ibn Ezra that he brings. It boils down to the idea that there is one mitzva: destroy them. The others are just for emphasis, to stress how important Timcheh is.

אמנם משמיה דהגרי"ש אלישיב זצ"ל מטו שהעיקר להבין את הענין ולא צריך להבין כל מילה ומילה (פסקי שמועות סי' תרפ"ה), וכ"כ בספר אגרת הפורים (להגרי"ד ספטימוס שליט"א) בשם הגר"נ קרליץ זצ"ל והגר"ח קניבסקי זצ"ל שמסתבר שמספיק להבין העניין של פרשת זכור ואין צריך להבין כל המילים עיי"ש

I have to point out that nobody is machmir like Rav Shternbuch. If you were, then every amoretz who got an aliyah would be making a bracha levatala. See Aruch Hashulchan OC 139:3 and Reb Moshe (OC II:72) .

Simla in 22:3, וְכֵן תַּעֲשֶׂה לְשִׂמְלָתוֹ and 22:5, וְלֹא יִלְבַּשׁ גֶּבֶר שִׂמְלַת אִשָּׁה

and Salma; 24:13  וְשָׁכַב בְּשַׂלְמָתוֹ וּבֵרְכֶךָּ

Necheshalim, 25:18, וַיְזַנֵּב בְּךָ כׇּל־הַנֶּחֱשָׁלִים אַחֲרֶיךָ. This does not mean stumbling. Stumbling is spelled with a Chof, מכשול. 

Our word is shoresh חשל. According to Rashi, it comes from Necheloshim, weak, shoresh חלש.  See Mizrachi:

כל הנחשלים חסרי כח כו'. פי' נחשלי' כמו נחלשים כמו כבש כשב כבשה כשבה

According to Onkelos, it comes from Neshecholim, stragglers, those who fell behind, shoresh שחל. See Gur Aryeh:

הנחשלים תרגם אונקלוס דהוו מתאחרין. ונראה לי דאונקלוס תרגם לשון "נחשלים" מלשון 'כמשחל'. אף על גב דשם השי"ן קודם, מצינו הרבה כזה. והוא לשון הוצאה, כמו שתרגם אונקלוס "כי מן המים משיתהו" (שמות ב, י) 'שחלתיהו'.

Both Rashi and Onkelos are saying it is a reversal of letters. I believe that in this case, the letters were reversed davka to include this multitude of interpretations, even a remez to stumbling.

Just for showing off my wife: Here are two more exchanged letter words my wife pointed out to me:

There is one that refers to the molar teeth, which appears as וָאֲשַׁבְּרָה מְתַלְּעוֹת עַוָּל וּמִשִּׁנָּיו אַשְׁלִיךְ טָרֶף in Iyov 29:15 and as אֱלֹהִים הֲרׇס שִׁנֵּימוֹ בְּפִימוֹ מַלְתְּעוֹת כְּפִירִים נְתֹץ יְהֹוָה in Tehillim 58:7.

כסיל in Tehillim and MIshlei, and סכל in Koheles and Yermiahu.

Questions for Ki Seitzei

1.  When Hagar and Yishmael were evicted from their home, Yishmael was dying of thirst, and Hashem was about to reveal water to Hagar so he would live. The malachim said, Ribono shel Olam, this person, Yishmael, will bring such death and suffering to your people, and you are saving him? Hashem answered that He judges him באשר הוא שם, as he is now, not what he will be in the future. We mention this on Yom Kippur as well, and ask that Hashem judge us as we are when we've done teshuva. In this parsha we see the exact opposite. Where do we see this, and how would you distinguish between the two. 

2. The word קדש means holy. We say נקדש את שמך בעולם, and אין דבר שבקדושה בפחות מעשרה. In this parsha, find this word used once in its usual sense, and twice meaning the exact opposite. 

3.  Simlah is not gender specific. Examples:  ואהב גר לתת לו לחם ושמלה   and  שמלתך לא בלתה מעליך ורגלך לא בצקה.  So why in 24:5 does it say לא יהיה כלי גבר על אשה ולא ילבש גבר שמלת אשה, a woman should not carry a man’s kli and a man should not wear a woman’s simlah? Aren’t they both words for clothing?

Ben Sorer Umoreh, who is subject to capital punishment not for anything he has done, but for the crimes his inexorable trajectory will lead to. 

Why are they different? In my experience, people prefer explanations they come up with, and just don't like explanations they are told. So you're on your own. I, and my mother זכרונה לברכה, preferred the Mizrachi's explanation with a very important modification. Baasher hu sham is only for the בית דין של מעלה PLUS tefilla, Hagar's tears.

As Rashi says in 22:9, the word kodesh essentially means "designated for a use that renders it untouchable."

Because men often carry or  wear non-clothing items that are associated with men only, such as a sword. Such items that are associated exclusively with women are carried in equal part for their decorative qualities, such as a purse, or a wrist watch, which includes them in in Simlah. (In other words, a woman will carry an empty purse and a wrist watch that is not working.) (taama dikra)

There are some who believe that wearing a tie is a problem for a man, because it is only decorative and non-functional. Some argue on the basis of the reference to men wearing earrings in the story of the Eigel:  Shemos 32:2-3,

וַיֹּאמֶר אֲלֵהֶם אַהֲרֹן פָּרְקוּ נִזְמֵי הַזָּהָב אֲשֶׁר בְּאׇזְנֵי נְשֵׁיכֶם בְּנֵיכֶם וּבְנֹתֵיכֶם וְהָבִיאוּ אֵלָי׃

וַיִּתְפָּרְקוּ כׇּל־הָעָם אֶת־נִזְמֵי הַזָּהָב אֲשֶׁר בְּאׇזְנֵיהֶם וַיָּבִיאוּ אֶל־אַהֲרֹן׃.

But the ibn Ezra there says this was a habit some picked up in Mitzrayim, not a Jewish behavior:

ויאמר פרקו. על משקל ברכו מהבנין הכבד הדגוש. מנהג מצרים היה לשום נזמים באזניהם. וככה כתוב במדינים כי ישמעאלים הם

and the Radal in Pirkei d'Rebbi Eliezer, where the Mishna (45:5) says 
רָאוּ הָאֲנָשִׁים שֶׁלֹּא קִבְּלוּ הַנָּשִׁים לִיתֵּן אֶת נִזְמֵיהֶן לְבַעֲלֵיהֶן, וְעַד אוֹתָהּ שָׁעָה הָיוּ הַנְּזָמִים בְּאָזְנֵיהֶם כְּמַעֲשֵׂה הַמִּצְרִיִּים וּכְמַעֲשֵׂה הָעֲרָבִים, וּפָרְקוּ אֶת נִזְמֵיהֶם שֶׁבְּאָזְנֵיהֶם
says (45:23)
 כמעשה המצרים וכמעשה הערביים. ר"ל שהן קיבלו מנהג זה מן המצריים שהיו נוהגים כערביים שהן הישמעאלים שכתוב עליהן במקרא [שופטים ח] כי נזמי זהב להם כי ישמעאלים הם (אבל בשאר כל האומות אין נוהגים האנשים לשום נזמים באזניהם רק הנשים,

Rashi says this clearly here:

למען יברכך. וְאַעַ"פִּ שֶׁבָּאת לְיָדוֹ שֶׁלֹּא בְמִתְכַּוֵּן, קַ"וָ לָעוֹשֶׂה בְמִתְכַּוֵּן. אֱמֹר מֵעַתָּה נָפְלָה סֶלַע מִיָּדוֹ וּמְצָאָהּ עָנִי וְנִתְפַּרְנֵס בָּהּ — הֲרֵי הוּא מִתְבָּרֵךְ עָלֶיהָ (ספרי):

Some argue and say that the mitzva is really to leave it there after you remember. But that is not true. It says (24:19)

כִּי תִקְצֹר קְצִירְךָ בְשָׂדֶךָ וְשָׁכַחְתָּ עֹמֶר בַּשָּׂדֶה לֹא תָשׁוּב לְקַחְתּוֹ לַגֵּר לַיָּתוֹם וְלָאַלְמָנָה יִהְיֶה לְמַעַן יְבָרֶכְךָ ה' אֱלֹהֶיךָ בְּכֹל מַעֲשֵׂה יָדֶיךָ

As soon as you forgot it, it becomes the property of the poor. Not going back and stealing it is no reason for a bracha. It must be that the bracha and the mitzva is for forgetting it. (Reb Yaakov.)

Also, this is assumed by many meforshim. Examples:

Aruch Hashulchan H'asid Hilchos Peah 9:1

ומשונה מצוה זו מכל מצות שבתורה שכל מצות שבתורה אין באים אלא על ידי זכירה כדכתיב וזכרתם את כל מצות ד' ועשיתם אותם ואם נשכח לא נעשה המצוה ומצוה זו היא להיפך שא"א לקיים המצוה רק ע"י שכחה והקב"ה זיכהו במצוה זו

Tosefta Peiah 3:13

מעשה בחסיד אחד ששכח עומר בתוך שדהו, ואמר לבנו צא והקריב עלי פר לעולה ופר לשלמים. אמר לו אבא מה ראית לשמוח בשמחת מצוה זו [יותר] מכל מצות שבתורה? אמר לו כל מצות שבתורה נתן [להם המקום] לדעתנו, זו שלא לדעתנו. שאילו [עשינוהו ברצון לפני המקום לא באת מצוה זו לידינו. [אלא] הרי הוא אומר (דברים כד) כי תקצור וגו' קבע לו הכתוב ברכה. והלא דברים קל וחומר, מה אדם שלא נתכוין לזכות וזכה מעלין עליו כאילו זכה, המתכוין לזכות וזכה על אחת כו"כ.

It happened with a certain pious person that he forgot a sheaf in his field, and he said to his son, “Go and sacrifice in my name a bull for Korban Olah and a bull for Korban Shlamim.” He said to him, “Father! What have you seen in this commandment to rejoice more than all [other] commandments that are mentioned in the Torah?” He said to him “All commandments in the Torah have been given to us by God consciously.   [But] this unconsciously, because if we would have done it willingly in front of God, this commandment would not be counted for us.” He said [back] to him , “It says, ‘When you will harvest your harvest in your field and you will forget a sheaf in the field, do not go back to take it. It shall be [left there] for the Non-Jewish resident, for the orphan, and for the widow, in order that Hashem, your God, will bless you with all the deeds of your hand.’ (Devarim 24:19) The verse has granted him a blessing.  Is not it a Kal Vechomer? Just like someone who did not intend to do something good, but he [ended up] doing something good [anyway], the verse considers him as if he has done something good, so for sure someone who intended to do something good, and [ended up] doing something good how much more so?”

Is this really true?

No. אין אדם דר עם נחש בכפיפה אחת.   My assumption is that he, contemplating a miserable and expensive future, will pay her to accept a get- the present value of everything he'll have to spend to keep her, plus the benefit of not having her sneering at him and poisoning his home atmosphere for his whole life.

צפרנים

It does say צפורן שמיר  in Yirmiahu 17:1,  חטאת יהודה כתובה בעט ברזל בצפרן שמיר חרושה על לוח לבם ולקרנות מזבחותיכם, but it doesn’t mean fingernail there. It means a sharp pointed inscribing instrument, like hammer and nails. So the צפרנים  in our parsha still counts as a one time word.

Henry wanted to marry his brother, Arthur's, widow, Catherine of Aragon, in 1509, but was told he could not because she had been married to his brother. They accepted the issur of a woman once married to a brother, but did not accept the mitzvah of Yibum that we find in this week's parsha. So he called up the Pope, and said "Pope, can you annul Catherine's marriage to Arthur? It was never consummated." And the Pope said, "ok, fine, I'll grant a dispensation."  Henry married her. Catherine didn't have male children and he wanted to get rid of her and formalize his relationship with his mistress, Anne Boleyn. The problem was that the Church did not allow divorce at all, even though it's in this week's parsha. He called the Pope again. He said "Good Yontif, Pontif. It's Henry. I'd like for you to annul the marriage to Catherine." The Pope said, "What are you talking about? I did that like twenty five years ago!" Henry said, "No, I mean the marriage between me and her."   The Pope said, "What, this also wasn't consummated? So where did Bloody Mary come from? Stop bothering me. No more dispensations, and forget about any annulments." So Henry went and created the Anglican church, his Archbishop annulled their marriage, and he married his paramour, Anne Boleyn. (This marriage was also sub-optimal.)

England became Anglican, Ireland remained Catholic, the Anglicans treated the Irish Catholics terribly, and this all led to the Irish Rebellion of 1798 and the endless trouble that followed.

The point is, that if had done Yibum, he could have had Katherine without calling the Pope, and when he wanted to move on to Anne Boleyn, he could have simply divorced her.  There would have been no need to found the Anglican Church.  From here we see that it is important to pay attention to the Krias HaTorah.

Corpse Flowers, Carrion Flowers, Durian, Skunk Spray, and Davening

It's been a while since I added pictures to these posts. This one really calls for it. 

The Mishna in Brachos 22b tells us that one may not daven in the vicinity of something that produces a disgusting smell.  This is a broad prohibition, which includes all vocalized words of kedusha, from tefilla to brachos to words of Torah. Under some circumstances, it even prohibits thinking Torah thoughts.

ירד לטבול אם יכול לעלות ולהתכסות ולקרות עד שלא תהא הנץ החמה יעלה ויתכסה ויקרא ואם לאו יתכסה במים ויקרא ולא יתכסה לא במים הרעים ולא במי המשרה עד שיטיל לתוכן מים וכמה ירחיק מהן ומן הצואה ד' אמות:

The gemara there adds that davening in such a place is not tefilla at all; One who davens there transgresses an issur. His 'prayer' is an affront to God, not praise. 

 היה עומד בתפלה וראה צואה כנגדו מהלך לפניו עד שיזרקנה לאחוריו ד' אמות והתניא לצדדין ל"ק הא דאפשר הא דלא אפשר היה מתפלל ומצא צואה במקומו אמר רבה אע"פ שחטא תפלתו תפלה מתקיף ליה רבא והא זבח רשעים תועבה אלא אמר רבא הואיל וחטא אע"פ שהתפלל תפלתו תועבה :

(Even though Rava's shitta in Temura 4 is כל מילתא דאמר רחמנא לא תעביד אי עביד לא מהני, so he should have passeled the tefilla on that basis alone, evidently the circumstantial nature of the issur makes אי עביד לא מהני inapplicable; but he passels on the basis of זבח רשעים תועבה , similar to אין זה מברך אלא מנאץ.)

Now that Rava used the expression דבר השם בזה on one who davens there, the poskim give terrible warnings to one who disregards this issur, to the extent that he is said to be Chayav Kareis, because כי דבר ה' בזה ואת מצותו הפר הכרת תכרת הנפש ההוא עונה בה.  (See Mishna Berura 79 sk 5, and Gra in אמרי נועם ברכות כד ע"ב ד"ה כי, and Shulchan Aruch Harav 85a.)

This issur is derived from the passuk in Ki Seitzei, Devarim 23:15, 

כי ה' אלהיך מתהלך בקרב מחנך להצילך ולתת איביך לפניך והיה מחניך קדוש ולא יראה בך ערות דבר ושב מאחריך

Certainly מחניך קדוש pertains to human waste. According to the Rashba, ולא יראה בך also applies to צואה and בית הכסא, and so davening כמלא עיניו is also אסור מדאורייתא. (see Pri Megadim brought in Biur Halacha hakdama to OC 79.)

(Even in our time of hygienic plumbing, this halacha has practical application: for example, if you have a litter box in your house; or if there is a port-a-potty at a construction site. In both cases, if you are facing them, it is assur to daven, no matter how far away they are.)

So my question is: does this apply to other objects that produce a disgusting odor, or only the items listed in the Mishna and the Gemara.

Answer: Mishna Berura 79 sk 23:

(כג) ריח רע - היינו כל שדרך בני אדם להצטער מאותו הריח. כתב הח"א דבר שטבעו ריח רע כגון עטרן וכדומה מותר ולא נקרא צואה אלא מה שנסרח מחמת עיפוש וכ"כ בספר מנחת שמואל:

עטרן is pitch, which the Gemara in many places considers to have a repulsive odor. 

So the Mishna Berura is paskening that disgusting smells do not interfere with tefilla, unless they are the product of decomposition/digestion. 

Rav Chaim Kanievsky (נקיות וכבוד בתפילה תשובה עב) is quoted as having said that one may daven when smelling the repellant odor of osmidrosis and bromidrosis, more commonly known as Body Odor.  (I do not know how this shtims with the issur of beis hamerchatz, which is bacause of zuhama, when the zuhama is just the water and steam people used to bath. If human body odor is not a problem, why would beis hamerchatz be a problem?) Rav Chaim Vital is quoted as saying the halitosis is not incompatible with tefilla (תשובות באר מים חיים פג) . 

In Siman 86 sk 3 the Mishna Berura assers davening in a wine cellar where there is a powerful malodor; evidently this is understood to be the result of decomposition. 

I understand the logic behind the distinction; מי משרה וצואה involve objects that are decayed and rotten. Things that have a foul odor by their nature are exactly as they should be. 

If you've ever had Durian, as I have, you know that some people are extremely disgusted by its smell. Sure, some people love it, but dogs love the smell of human waste and decaying flesh, and that doesn't change the halacha. In the Philippines, you will find legal warnings prohibiting the possession of Durians in hotels or public transportation. 


Similarly, the Corpse Flower, the amorophophallus titanum, produces the exact same chemicals that cause the miasma of rotting flesh, i.e., cadaverine and putrescene.  Or the less showy but equally horrid stapelia gigantea, Carrion flowers, which also produce cadaverine?
Can you daven in a room that has durian and corpse and carrion flowers? 

Another important application: In Israel, the police use a crowd dispersant called בואש, which leaves a powerful odor similar to rot or sewage on whatever it touches. May one daven if he is suffused with this odorant? 

Evidently, the answer is yes. You may.

שנינו (שבת ב' ב') 'אין מדליקין בעטרן מפני כבוד השבת', ומבאר הירושלמי (שבת ב' ב') 'עיטרן בין כבה בין דלק ריחו רע, שלא תאמר הואיל וריחו רע יהא טעון הרחק ארבע אמות - לפום כן צריך מימר אין מדליקין בו', וביאר הפני משה 'אגב אורחיה אשמעינן שלא תאמר דינו כשאר ריח רע לענין ק"ש ותפלה וצריך הרחק ד' אמות ממנו - לפום כן צריך מימר דלענין הדלקה בלבד הוא דאמרו'; מכאן למד החיי אדם (א' ג' י"ב, הובא במ"ב ע"ט כ"ג) 'כשם שמרחיקין מן הצואה כך מרחיקין מן הריח רע אפילו אינה צואה, וכל שדרך בני אדם להצטער מאותו ריח נקרא ריח רע... נראה לי דדבר שטבעו ריח רע, מותר, ולא נקרא צואה אלא מה שנסרח מחמת עיפוש', הרי שהוסיף תנאי בריח רע - שיהא זה ריח של דבר שהתקלקל, ולא ריח טבעי שהדרך להצטער ממנו.
וכן מצאנו במ"ב (ע"ט כ"ג) שהביא את הגדרת החיי אדם, וכן כתב (מ"ב צ"ח ז'): '...אין להתפלל בבית שיש שם שכר חדש או מי דבש [מפני חסרון הכוונה], וכ"ש ריח רע מעופש קצת'; וכן הוסיף (מ"ב רכ"ז ט') על מ"ש השו"ע שאין לברך על הרעמים בבית הכסא: 'וה"ה אם היה בבית שמקצבין בו בשר דשם ריח מעופש מאד, או שהיה הולך במבואות המטונפות...'; וכ"כ (מ"ב פ"ו ג'): 'כתב הא"ר והובא בפמ"ג במרתפות היין שיש ריח רע מעופש וקץ ביה אסור לקרות ק"ש, וה"ה כל כה"ג'; אמנם, הוסיף שם להסתייג מכך 'וברמב"ם (תפילה ד' ט' 'גדולי החכמים לא היו מתפללים בבית שיש בו שכר ולא בבית שיש בו מורייס בעת עפושו - מפני שריחו רע') משמע דמותר, ורק גדולי החכמים היו נזהרין מזה בעת התפלה, עיין שם, ולפלא שלא העירו בזה', אך דחה את עצמו בשעה"צ (רכ"ז י"א): 'אפשר דהכא [בבית שמקצבין בו בשר] - משום דיש ריח רע יותר גדול, ועל כן נחשב זה כמבואות המטונפות, ובהכי נוכל לישב ההיא דסימן פ"ו שהבאתי שם בשם אליה רבה דמרתפות היין גם כן אין לדבר שם דברי תורה [שמדובר כשקץ בריח הרע המעופש], ובחנם השגתי שם עליו [מהרמב"ם דמיירי בריח מורייס מעופש, אך לא קץ בו כל כך - ורק בכה"ג התיר מעיקר הדין], עיין שם'; הרי שלמסקנת המ"ב רק ריח רע מעופש שקץ בו ביותר הוא בכלל טינוף, אך דבר שריחו מעופש קצת איננו בכלל טינוף, אם כי הוא עלול לבטל את הכווונה בעת התפילה, ולכן גדולי החכמים לא היו מתפללים שם.

The raya from the Yerushalmi is not strong. That Yerushalmi might just mean that the smell is not so repulsive as to be incompatible with tefilla. But the Mishna Berura is a safe harbor; you can't go wrong relying on the Mishna Berura.

Polygamy in Practice

There are many things that are muttar but ought to be avoided, even if the Torah says befeirush that you can do it. The best example is the parsha of יפת תואר, that reminds us that doing something that the Torah is mattir is not always advisable, and can even have pernicious consequences.  Similarly, the Ramban in Kedoshim teaches us the idea of נבל ברשות התורה, that while gluttony is not assur, it is morally and spiritually contemptible. Asking for a king to lead the nation instead of leadership by Neviim is allowed, but, as Shmuel warned the people, it was a lamentable decision. 

So too, polygamy (polygyny), is absolutely allowed (21:15) under Torah law - כי תהיין לאיש שתי נשים - but it was never the standard. Polygamy was practiced only when particular circumstances created a special need.  I believe that this was because the optimal model of marriage involves a communion of emotion and trust that requires exclusivity.  דו פרצופין is very different than three.


Starting from the beginning, we have Lamech in Breishis 4:19,

ויקח־לו למך שתי נשים שם האחת עדה ושם השנית צלה

Rashi comments that the pre-mabul generations would take two wives; one who was treated like breeding stock, to bear children, and one for pleasure, the beautiful life-consort - the pampered trophy wife - who was sterilized to preserve her youthful appearance. This behavior was viewed as emblematic of the decadent Dor HaMabul. 

שתי נשים. כָּךְ הָיָה דַּרְכָּן שֶׁל דּוֹר הַמַּבּוּל אַחַת לִפְרִיָּה וּרְבִיָּה וְאַחַת לְתַשְׁמִישׁ, זוֹ שֶׁהִיא לְתַשְׁמִישׁ מַשְׁקָהּ כּוֹס שֶׁל עִקָּרִין כְּדֵי שֶׁתֵּעָקֵר וּמְקֻשֶּׁטֶת כְּכַלָּה וּמַאֲכִילָהּ מַעֲדַנִּים, וַחֲבֶרְתָּהּ נְזוּפָה וַאֲבֵלָה כְּאַלְמָנָה, וְזֶהוּ שֶׁפֵּרֵשׁ אִיּוֹב רֹעֶה עֲקָרָה לֹא תֵלֵד וְאַלְמָנָה לֹא יְיֵטִיב (איוב כ"ד), כְּמוֹ שֶׁמְּפֹרָשׁ בְּאַגָּדַת חֵלֶק (וּבִבְ"רַ):

Then come the Avos Hakedoshim. Neither Avraham Avinu nor Yaakov Avinu took additional wives on their own initiative. It was their primary wife that arranged for their husband to take more wives. Sarah offered Hagar, Rachel ensured that the marriage to Leah would be consummated, Rachel offered Bilha, and Leah offered Zilpah.

We also find that Lavan viewed the taking of additional wives as an offense against the primary wife, or, in this case, wives. (31:50)

אם תענה את בנתי ואם תקח נשים על בנתי אין איש עמנו ראה אלהים עד ביני ובינך

Of course, kings had many wives, but those were to cement political alliances. Perhaps another reason is because political power enflames the libido, and what is adequate for the average man is not enough for a king, similar to the din of Yefas Toar to a victorious warrior.

Gidon and Yair Haglili did have many wives, but I think they were exceptions, perhaps because they were shoftim and therefore like kings, or they anticipated becoming kings.

Gideon, the sixth Shofet:

שופטים ח:כ"ט    ולגדעון היו שבעים בנים יצאי ירכו כי נשים רבות היו לו   ופילגשו אשר בשכם ילדה לו גם היא בן וישם את שמו אבימלך

Yair Hagiladi, the eighth Shofet:

שופטים י, ג-ה    וַיָּקָם אַחֲרָיו יָאִיר הַגִּלְעָדִי וַיִּשְׁפֹּט אֶת יִשְׂרָאֵל עֶשְׂרִים וּשְׁתַּיִם שָׁנָה. וַיְהִי לוֹ שְׁלֹשִׁים בָּנִים ...


Rav Reuven Margolios in his sefer עוללות Perek 6 "ריבוי נשים" pages 15-18 (a book well worth reading!) brings many rayos that חז"ל envisioned the optimal marriage as the personal relationship between one man and one woman.  His Pesikta and the Targum  are knockouts. Here are his words.

פסיקתא רבתי פסוק מד, שעל המסופר בשמואל א (א, א): וַיְהִי אִישׁ אֶחָד מִן הָרָמָתַיִם צוֹפִים וגו', אמר רבי יונה משום רבי: ואחר כל השבח הזה כתוב בו וְלוֹ שְׁתֵּי נָשִׁים (שם ב), ולמה נטל שתי נשים בשביל ויהי לפנינה ילדים ולחנה אין ילדים (שם) כיון שראתה חנה שלא ילדה אמרה אומר לו שיכניס צרתי לביתי ומתוך זה יראה הקב"ה שהכנסתי צרתי לביתי ויפקוד אותי אמר לה הקדוש ברוך הוא חייך (את) חנה הפקדת אצלי נפשות [נפשות] אני משלם (לידך) [ליך] כי פקד ה' את חנה: 

בתרגום רות ד, ו, פסוק: לֹא אוּכַל לִגְאָל לִי פֶּן אַשְׁחִית אֶת נַחֲלָתִי, מתורגם: לית אנא יכיל למיפרק לי על דאית לי איתתא לית לי למיסב אוחרניתא עלהי דילמא תהא למצו – מריבה – בביתי, פרוק לך את ארום דלית לך איתתא, וראה בבבא בתרא צא, א, שספרו כי אותו יום שבאה רות המואביה לארץ ישראל מתה אשתו של בועז.

וכן גם בתקופת רבותינו חכמי המשנה והתלמוד. ראה מו"ק ט, ב: רבי יונתן בן עסמיי ורבי יהודה בן גרים תנו פרשת נדרים בי רבי שמעון בן יוחי… אמר ליה לבריה: בני אדם הללו אנשים של צורה הם, זיל גביהון דליברכוך. אזל, אשכחינהו דקא רמי קראי אהדדי… אמרו ליה: מאי בעית הכא? אמר להו: דאמר לי אבא: זיל גבייהו דליברכוך. אמרו ליה: יהא רעוא דתזרע ולא תחצד… ולא תחזי שתא חדתא. כי אתא לגבי אבוה, אמר ליה: לא מבעיא דברוכי לא בירכן – אבל צעורי מצערן. אמר ליה: מאי אמרו לך? – הכי והכי אמרי לי. אמר ליה: הנך כולהו ברכתא נינהו: תזרע כו' ולא תיחזי שתא חדתא – דלא תמות אנתך ולא תנסב אינתתא אחריתי [ובכוונה ביטאו את ברכתם בסגנון מליצי, שלא יבין ויצטרך לספר לאביו והוא יפתור לו חידתם, ובזה יבורך מפי אביו רבם]. הרי ששני הדברים קשורים זה בזה, ואם לא על ידי מיתת הראשונה בודאי לא יחזי שתא חדתא.

בכתובות סב, ב, מסופר: רבי איעסק ליה לבריה בי רבי יוסי בן זימרא [אירס בנו עם בתו של רבי יוסי בן זמרא] כו', יתיב תרתי סרי שני בבי רבי, עד דאתא – איעקרא דביתהו. אמר רבי: היכי נעביד? נגרשה, יאמרו ענייה זו לשוא שימרה! נינסיב איתתא אחריתי, יאמרו: זו אשתו וזו זונתו! בעי עלה רחמי ואיתסיאת (ע"כ). הרי כי קשה היה בעיני רבי שישא אשה עליה, גם כשחשבו שלא תוכל עוד ללדת.

וראה יבמות לד, ב: כי אתא רבין אמר רבי יוחנן: כל ששהתה אחר (מיתת) בעלה עשר שנים ונשאת – שוב אינה יולדת. אמר רב נחמן: לא שנו אלא שאין דעתה להנשא, אבל דעתה להנשא – מתעברת. אמר ליה רבא לבת רב חסדא [אשתו של רבא, רש"י]: קא מרנני רבנן אבתריך [ששהתה עשר שנים אחר בעלה הראשון ואח"כ כשנישאת לרבא ילדה]! אמרה: אנא דעתאי עלך הואי. ובתוס' שם: אמר רבינו תם משום ההיא עובדא דפ"ק דב"ב (יב, ב) דאמרה בת רב חסדא תרווייהו קבעינא, 1 והיתה מצפה שתתקיים נבואתה, לפי שהיה לרבא אשה אחרת, איחרה לינשא לו (ע"כ). הרי שגם רבא הסובר להלכה כי יכול אדם לשאת אשה על אשתו אי אית ליה למזנייהו (יבמות סה, א), הנה למעשה לא עלתה על דעתו שתינשא לו בת רב חסדא כל עוד אשתו בחיים, אם כי ידע שהיא מיועדת לו.

ולא רק בחוג גדולי האומה – כי אם גם בכל המוני ישראל לא היה מצוי שתהיינה לאיש שתי נשים יחד, כאשר נווכח מסגנונם בהמסופר (סוף תענית) על חגיגות בנות ישראל שהיו יוצאות וחולות בכרמים ואומרות: בחור שא נא עיניך, הנה נקטו: מי שאין לו אשה נפנה לשם.

וביבמות כה, א: המביא גט ממדינת הים ואומר בפני נכתב ובפני נחתם – לא ישא את אשתו, שחיישינן שמא עיניו נתן בה ולכן יעיד בשקר שנתגרשה, וסיימו שם שאם באותו זמן כשבאו להעיד היו לעדים נשים משלהם, מותרות לינשא להם, באשר לא היה מקום לחשוד כי בהעידו חשב להתירה לעצמו אחרי כי אשתו היתה קיימת אז, ואם אחרי כן מתה אשתו הלוא בהעידו לא ידע מראש שתמות, ולכן עדותו נאמנה. ואלמלי היו רגילים לשאת שתי נשים יחד הרי תמיד יש מקום לחשד שהוא מתכוון לשאת גם אותה; ברור איפוא כי לא היה מצוי בישראל בכל שדרות העם שישא אדם אשה על אשתו.

וראה בקהלת רבה פרק יא: בַּבֹּקֶר זְרַע אֶת זַרְעֶךָ, רבי יהושע אומר: נשאת אשה בילדותך ומתה – תשא בזקנותיך כו', ולא אמרו כי משום לָעֶרֶב אַל תַּנַּח יָדֶךָ ישא אשה חדשה על אשתו שנזדקנה. ובכתובות עז, סוף ע"א: נשא אשה ושהה עמה עשר שנים ולא ילדה, כופין אותה להוציא, משום דכל כמה דאיתא להא גביה לא נסיב אחריתי. ובכל אלפי מאורעות וסיפורים שבספרות התלמוד אין אנו מוצאים כל הד למציאות זו, מלבד באפוטרופוס אחד שאצל אגריפס המלך, ראה סוכה כו, א. ואולי גם שם היתה איזו סיבה דוגמת דברי הפסיקתא רבתי שהזכרתי על אלקנה אבי שמואל. ומה שאמר רבי אליעזר הגדול (סנהדרין סז, ב) ביום פטירתו על הורקנוס בנו: דעתו ודעת אמו נטרפה – הוא בן אשתו השנייה בת אחותו, ראה אבות דרבי נתן פרק טז, אחרי שאשתו הראשונה, אחותו של רבן גמליאל מתה מקודם אחרי פטירת אחיה, ראה בבא מציעא נט, ב, ובהקדמת הגרד"ל לפרקי דרבי אליעזר.

ברור איפוא כי המסופר במדרש אגדה שי"ב נשים היו לבר קפרא יחד והן פרנסו אותו, הן הן היבמות שעליהן יסופר בירושלמי שהבאתי".

Rav Margolios did not have to mention the other cases of plural marriage in the Gemara, because first of all, they were most likely green card marriages, and anyway the special circumstances are obvious:

 רב כי מקלע לדרשיש מכריז מאן הויא ליומא רב נחמן כד מקלע לשכנציב מכריז מאן הויא ליומא והתניא ר' אליעזר בן יעקב אומר לא ישא אדם אשה במדינה זו וילך וישא אשה במדינה אחרת שמא יזדווגו זה אצל זה ונמצא אח נושא אחותו (ואב נושא בתו) וממלא כל העולם כולו ממזרות ועל זה נאמר (ויקרא יט, כט) ומלאה הארץ זמה אמרי רבנן קלא אית להו והאמר רבא תבעוה להנשא ונתפייסה צריכה לישב שבעה נקיים רבנן אודועי הוו מודעו להו מקדם הוו מקדמי ומשדרי שלוחא ואי בעית אימא יחודי הוו מיחדי להו לפי שאינו דומה מי שיש לו פת בסלו למי שאין לו פת בסלו:

and the Tosefta Rashi brings in Kiddushin 71a (also Yerushalmi יבמות פרק ד הי"ב)

ור' טרפון היה כהן בתוספתא דכתובות (פ"ה) מעשה בר' טרפון שקדש שלש מאות נשים בשני בצורת כדי להאכילם תרומה:


In Yevamos 65a there is a machlokes Rav Ami and Rava about marrying a second wife when they are trying to single out the source of an interility problem. Rav Ami says that Wife One is entitled to demand an end to the marriage and despite her instigating the divorce, she is entitled to all the Kesuva payments. Rava argues and says that a man can marry a second wife as long as he can afford to support both of them properly.

אמר רבי אמי ... שאני אומר כל הנושא אשה על אשתו יוציא ויתן כתובה רבא אמר נושא אדם כמה נשים על אשתו והוא דאית ליה למיזיינינהי

The Ritva says that this machlokes is where Wife One protests.  If she is amenable, Rav Assi would not say that the marriage is not countenanced. 

כל הנושא אשה על אשתו יוציא ויתן כתובה, והא לא מתאמרא ודאי אלא כשהוא שלא ברצון אשתו יוציא ויתן כתובה, ועל הא אתא רבא לומר נושא אדם כמה נשים, אפילו שלא ברצון אשתו, והוא דיכול למיקים בסיפוקיי הו, והלכתא כרבא

But that Gemara is talking about circumstances when there is a special need to marry another woman, not just a personal desire to do so, but even so, Rav Assi says that the husband's need does not outweigh the wife's right to a monogamous relationship.

In fact, we find that Rav once spoke to Rav Assi about marrying more than one wife. Rav said to Rav Assi (Pesachim 113a) not to marry two, but if he has to marry more than one he should marry three. Rav's point is, and there's no reason to think Rav Assi differs, is that lechatchila, one. If circumstances mandate more, or if the wife does not protest, then three is  better than two.

The Gemara clearly envisions the perfect marriage as involving one man and one woman, as we see in the following maxims.

Yevamos 62b-63a

אמר רבי תנחום א"ר חנילאי כל אדם שאין לו אשה שרוי בלא שמחה בלא ברכה בלא טובה 

בלא שמחה דכתיב (דברים יד, כו) ושמחת אתה וביתך בלא ברכה דכתיב (יחזקאל מד, ל) להניח ברכה אל ביתך בלא טובה דכתיב (בראשית ב, יח) לא טוב היות האדם לבדו 

במערבא אמרי בלא תורה בלא חומה

ת"ר האוהב את אשתו כגופו והמכבדה יותר מגופו והמדריך בניו ובנותיו בדרך ישרה והמשיאן סמוך לפירקן עליו הכתוב אומר וידעת כי שלום אהלך האוהב את שכיניו והמקרב את קרוביו והנושא את בת אחותו והמלוה סלע לעני בשעת דחקו עליו הכתוב אומר (ישעיהו נח, ט) אז תקרא וה' יענה תשוע ויאמר הנני:

Sanhedrin 22a

א"ר אליעזר כל המגרש את אשתו ראשונה אפילו מזבח מוריד עליו דמעות שנאמר (מלאכי ב, יג) וזאת שנית תעשו כסות דמעה את מזבח ה' בכי ואנקה מאין עוד פנות אל המנחה ולקחת רצון מידכם וכתיב (מלאכי ב, יד) ואמרתם על מה על כי ה' העיד בינך ובין אשת נעוריך אשר אתה בגדתה בה והיא חברתך ואשת בריתך

Sotah 17a

דריש ר"ע איש ואשה זכו שכינה ביניהן לא זכו אש אוכלתן 


Note: 

Ron Abrams and Moish Pollak asked me, if polygamy was so rare, why did Rabbeinu Gershom find it necessary to make an unprecedented "cherem" against it? It seems like using a cannon to kill a fly.

The Chasam Sofer (EH 1:1.) suggests that Rabbeinu Gershom's main purpose was to stop forced divorces; In cases where the wife will absolutely refuse the accept a get, the husband might just give up on the divorce, and to have someone that doesn't hate him in the house, he will take another wife. This subverts RG's purpose, because he wanted to ensure that a divorce would be given after proper negotiation. (I assume that this was because she would only accept the divorce if she was made financially secure.)  If her husband could simply wall her off and marry someone else, she loses all her leverage.  It was to protect his cherem against forced divorce that he prohibited polygamy. 

ולולי דמסתפינא לחדש דבר שלא הזכירו הגאונים הקדמונים, הוה אמינא דר"ג הרי תיקן שתי תקנות… ונ"ל דהשניה תליא בראשונה – אחר שגזר שלא לגרש בע"כ, ולפעמים ע"כ שלא לרצונו ידור עם נחש בכפיפה אחת, עי"ז ישא אשה על אשתו ויתרבו קטטות בבתי ישראל ועניות מחזירות על הפתחים דלא מצי למיקם בספוקייהו, נמצא תקנתו שלא לגרש בע"כ קלקלה היא, ע"כ חזר ותיקן שלא לישא שתי נשים, אבל אי הו"מ מגרש בע"כ לא הוה גזור

The point is that it is true that polygamy was rare at the time. But Rabbeinu Gershom needed to prohibit it by force of Cherem because his takana prohibiting forced divorce was to protect women from simply being thrown out of the house into poverty. The woman's leverage was that if the husband did not make divorce liveable, she would refuse the get and the husband would remain without a true spouse. If he could ignore her and just take a second wife, her whole leverage would evaporate. To ensure that scoundrels would not resort to polygamy to subvert his intented protection of women in his takana against forced divorce, he formally eliminated the option of polygamy.


UPDATE:

I just came across a comment from Rav Yaakov Emden in his booklet against the Frankists and Sabbateans called רסן מתעה. He says in an apparently complimentary manner that the Christians took on certain chumros that prohibited even things that are Muttar to Klal Yisrael. One that he mentions is that they do not take two wives. But as you will see from his remark in his Teshuvos, he did not mean it as worthy of emulation for the Jewish people.

שאפילו אומות העולם גדרו גדר בעצמן אחר המבול. אין צורך לומר אומת הנוצרים. שהוסיפה לה גדרים להרחיק עצמן אף מן המותר לישראל. אפילו מה שאין ערוה לנו. וגם מה שהתירה תורה.שהרי אף לקחת איש אחד שתי נשים כאחת אינן מתירים. ואחות אשה גם אחר מות אחותה וקרובות זולת זה להם אסורים.

But take a gander at his Tshuvos Yaavetz II 15, the famous teshuva that sets forth his positive view of having a pilegesh. He also addresses polygamy, and he says he is inclined to throw out the whole Cheirem of Rabbeinu Gershom on the basis of בחוקותיהם לא תלכו of the Christians. I've made the relevant passages bold.
