Tzedaka for Teshuva

Rosh Hashanna 16b: Four things tear up a bad gzeira: Tzedaka, Crying out, Changing the name, and Changing actions. Some say, also Changing dwelling (i.e., galus.)



וא"ר יצחק ד' דברים מקרעין גזר דינו של אדם אלו הן צדקה צעקה שינוי השם ושינוי מעשה צדקה דכתיב וצדקה תציל ממות. צעקה דכתיב ויצעקו אל ה' בצר להם וממצוקותיהם יוציאם. שינוי השם דכתיב שרי אשתך לא תקרא את שמה שרי כי שרה שמה וכתיב וברכתי אותה וגם נתתי ממנה לך בן. שינוי מעשה דכתיב וירא האלהים את מעשיהם וכתיב וינחם האלהים על הרעה אשר דבר לעשות להם ולא עשה;וי"א אף שינוי מקום דכתיב ויאמר ה' אל אברם לך לך מארצך והדר ואעשך לגוי גדול. ואידך ההוא זכותא דא"י הוא דאהניא ליה

The Rambam applies this beyond "tearing up a bad gzeira", and says that these are "the ways of teshuva." Rambam Teshuva 2:4-
מדרכי התשובה להיות השב צועק תמיד לפני השם בבכי ובתחנונים ועושה צדקה כפי כחו ומתרחק הרבה מן הדבר שחטא בו ומשנה שמו כלומר אני אחר ואיני אותו האיש שעשה אותן המעשים ומשנה מעשיו כולן לטובה ולדרך ישרה וגולה ממקומו. שגלות מכפרת עון מפני שגורמת לו להכנע ולהיות עניו ושפל רוח:

Three elements are self explanatory. If your past is terrible and you need to escape what you've done and who you were, if you need to to start over, you have to cry out to Hashem for forgiveness, change your behavior and even your identity.  But what does giving tzedaka have to do with it?


My question is not on the the Gemara itself,only on the Rambam. The Gemara is talking about nullifying a bad gzeira. If a person needs to stop a bad gzeira, then tzedaka is clearly effective. We find this by the din of Kofer-  for certain sins, a person has to give money in penance. Most famously, we find this type of Kofer kapara  by an owner of an animal that killed a person; it also is found after the sin of the Eigel, that they gave kofer as a pidyon. Baalei mussar and poskim often apply this to one that sinned, that either he should fast or give to tzedaka the value of the meals he would eat for a day or whatever span of time he should have fasted. As the Gemara in Rosh Hashannah said, this is explicit in Mishlei, once in 10:2 - לא יועילו אוצרות רשע, וצדקה תציל ממות, and once in 11:4, לא יועיל הון ביום עברה, וצדקה תציל ממות. In fact, the Gemara in BB 10a-b says

א"ר חייא בר אבא רבי יוחנן (רמי) כתיב לא יועיל הון ביום עברה וצדקה תציל ממות וכתיב לא יועילו אוצרות רשע וצדקה תציל ממות שתי צדקות הללו למה אחת שמצילתו ממיתה משונה ואחת שמצילתו מדינה של גיהנם ואי זו היא שמצילתו מדינה של גיהנם ההוא דכתיב ביה עברה דכתיב יום עברה היום ההוא ואי זו היא שמצילתו ממיתה משונה נותנה ואינו יודע למי נותנה נוטלה ואינו יודע ממי נוטלה נותנה ואינו יודע למי נותנה 

So it's a simple fact  Tzedaka, done right, saves a person even from Gehinom, so it's the best thing a baal teshuva can do.
(As always, allow me to point out that optimally, one should not seek to exploit this simply for his own benefit, an act cynically referred to as "selfish altruism." One should allow the act of giving to engender in himself a true and deep empathy and love for his fellow. I wonder, it's possible that a person that gives with difficulty but forces himself to give because he wants the zechus of tzedaka, might be oveir on ולא ירע לבבך בתתך לו (Devarim 15:10.)

Additionally, one might argue, as Turnus Rufus did, that the poor suffer because that is Hashem's will, that there is a divinely ordained gzeira of poverty upon them. If so, it is not our place to interfere with that gzeira. Nonetheless, the aleph beis of being a Jew is that we give tzedaka. It doesn't matter what the gzeira is, tzedaka is appropriate. If so, we can say to Hashem that He has taught us that it doesn't matter what the gzeira is. The right thing is to give us tzedaka and relieve us.


But how does this relate to the mitzva of Teshuva itself?  Why does the Rambam say that these things are related to Teshuva?  It is possible that it has nothing to do with teshuva. It is possible that the Rambam is just telling us that these are the things that a baal teshuva should do, not because they are elements of teshuva, but because his sins ought to bring a gzeira of punishment upon him, and in order to erase that gzeira, he needs to do the things enumerated in the Gemara in Rosh Hashanna.


In Unesaneh tokef, when we say ותשובה ותפילה וצדקה מעבירין את רוע הגזירה, it also could mean that there are three separate things one must do to eliminate a gzeira, and those are teshuva, and tefilla, and tzedaka. It does not say and it does not even imply that tefilla and tzedaka are parts of teshuva.



However, the Rambam's language (מדרכי התשובה, not just מדרכי בעלי תשובה,) implies that he holds that these elements are related to the teshuva process, and not just things baalei teshuva do to prevent punishment for their sins. Again, I understand all of them, but not Tzedaka.

After reading the Chasam Sofer in his teshuvos (numbered differently in the various editions of added teshuvos- in one, called Likutei Teshuvos, it's 17, in another, it's 21,) the answer is clear, and I was guilty of assuming a false dichotomy. The Chasam Sofer says that  what we call "teshuva" means that if you have charata and vidui and kabbala you are to be called a good Jew, even a tzadik gamur.  But even after the teshuva is complete there remain the gzeiros ra'os that were nigzar because of the sin. Removing those gzeiros often takes more than teshuva alone- the Rokei'ach famously says that you need to suffer physical and emotional pain in payment or expiation for every single moment or act of pleasure you experienced in doing the sin. The Noda BiYehuda in OC 35 and Reb Moshe in OC 4:116 say the same thing, but the Chasam Sofer is most on target as far as our discussion, in that he asks the question we asked and then answers it. So I was wrong to say that there is teshuva itself, and after that, separately, there is the removal of the gzeiros of punishment. The pshat is that there are two disparate elements in the teshuva itself. The first step, which is what we are used to thinking of as the definitive "Teshuva," is regret for I act against Hashem. Failure to do teshuva aggravates the original sin by showing that you don't regret doing it, so, in a sense, the passive failure to repent means that you continue to be a sinner. Remorse, verbal admission, and abandonment of the sin means that you no longer are a sinner, and you are a tzadik gamur. But there remains the debt created by the act, and teshuva alone is not enough for expiation. Expiation is also part of teshuva. 

This is what Daniel told Nevuchadnetzar in 4:24-
להן מלכא מלכי ישפר עליך וחטיך [עלך וחטאך] בצדקה פרק ועויתך במחן ענין הן תהוא ארכה לשלותך

אודות עסק ביש, וז״ל: בתחלה צריכין אנו לבאר מהו תשובה המוזכרת בכל מקום, במס׳ יומא פ״ו ע״ב אמרינן היכי דמי חשובה, כל שבאת עבירה לידו פעם א׳ וב׳ וניצול הימנו, מחוי ר׳ יהודה באותו מקום ובאותו פרק ובאותה אשה, וזהו תימה, וכי מי שעבר על איסור אשח איש או שאר עריות חייבי מיתות ב״ד כריתות, בזה יכופר לו בעמדו באותו מקום וכו׳ ואינו חוטא, וכי על זה נאמר [שם] גדולה תשובה שזדונות נעשין זכיות. ועוד, וכי מי שעבר פעם אחת ומי שעבר עשרה פעמים תשובה אחת לשניהם. ועוד, חזינן לאבות הראשונים ה״ה הרוקח זללה״ה והשל״ה זללה״ה במס׳ ר״ה ברמזי ה׳ שופר מחמירין דבעי׳ סיגופים ותענית נגד כל כח וכח שבכל  בעילה, וכנגד כל כזית וכזית, והוא מתנגד לדרשת חז״ל הנ״ל.

וכן משמע בהרמב"ם הנ"ל שבפ"ב מה' תשובה הל' א' וב' כתב שהתשובה גמורה היא כשבא בידו דבר שעבר בו ואפשר לעשותו ופירש ולא עשה מפני התשובה ולא מכשלון כח וכו' והיינו העזיבה ובהלכה ב' שם כפל הענין שהתשובה היא העזיבה ושינחם על הרעה ומשמע שזה מהני אפילו לע"ז שמביא על זה קרא ולא נאמר עוד אלהינו למעשה ידינו וע"ש בכ"מ וא"כ משמע שזה יספיק לו ואח"כ בהלכה ד' כתב מדרכי התשובה להיות צועק תמיד וכו' וישנה שמו וגולה ממקומו ובהל' ה' מבאר יותר ע"ש והוי כסתרי אהדדי שבתחלה משמע שהעזיבה והחרטה לבד המה תשובה גמורה ואח"כ כתב שיגלה ממקומו אע"כ כנ"ל שעיקרי התשובה להיותו ישראל גמור כמקדם אעפ"י שעבד ע"ז מכיון שאמר ולא נאמר עוד אלהינו למעשה ידינו סגי אבל מדרכי התשובה שיתכפר לו חטאו ועונותיו יעשו זכיות הוא שיהיה צועק ומתחנן וגולה ממקומו 


So the Rambam is as clear as day. If a person is a rasha and wants to be a tzadik, to be a Baal Teshuva, all that's necessary is contrition, admission, and disciplined resolution. After teshuva, a person can be a tzadik gamur. But to be cleansed, one needs more, and that can be thought of as the second step of teshuva. Even a tzadik gamur might have terrible gzeiros against him. The Rambam holds that the items listed in Rosh HaShanna remove the gzeiros that the sin caused. The stigma is gone, but the heavenly court's judgment needs more, and that is Part Two of Teshuva. Part one of Teshuva does not necessarily include Part Two.

This explains the Gemara in Rosh Hashanna 18, that Abaye and Rabba were descendants of Eli hakohen and as such were cursed to die young. But Rabba lived to 40 due to his Torah and Abaye to 60 because of his chesed. They were tzadikim gemurim. They had never sinned in the first place. But history had put gzeiros into their lives, and those gzeiros needed expiation through Torah and Chesed. 
אמר רב שמואל בר נחמני אמר רב יונתן מנין לגזר דין שיש עמו שבועה שאינו נקרע שנאמר [ו]לכן נשבעתי לבית עלי אם יתכפר עון בית עלי בזבח ובמנחה אמר רבא בזבח ובמנחה אינו מתכפר אבל מתכפר בתורה אביי אמר בזבח ומנחה אינו מתכפר אבל מתכפר בתורה ובגמילות חסדים רבה ואביי מדבית עלי קאתו רבה דעסק בתורה חיה ארבעין שנין אביי דעסק בתורה ובגמילות חסדים חיה שיתין שנין 
The point is that their gzeira had nothing to do with being wicked. It was what they were born with due to the gzeira against their ancestor. They didn't have to do teshuva, and for them to do teshuva would have no relevance to the inherited gzeira.  Their reprieve was earned through chesed and limud hatorah.

This can be said very simply. As a general rule, what we call teshuva is so that you will be counted as a tzadik and not a rasha. Tzedaka is the second step. Tzedaka is to prevent yesurim. Teshuva does not help against yesurim, and tzedaka does not help to make you a tzadik. 

I assume this is only true by teshuva mei'yir'ah, not teshuva mei'ahava, but that's just an assumption.

I do admit, though, that I'm not sure about whether it's part of teshuva per se, or it is simply something a baal teshuva ought to be doing. My doubt stems from the Rambam's words מדרכי התשובה. If he held it was part of teshuva, he would have said מחלקי התשובה, not מדרכי התשובה. But I don't think it really matters. The lesson, the insight into what teshuva is all about and the role of tzedaka, is the same either way.

To sum up in the words of the Chafetz Chaim, I include a section of the translation of the Ahavath Chesed, done by Rabbi Leonard Oschry for Feldheim publishers in 1967. Rabbi Oschry's translation is done beautifully, as is all his work. (The Oschry family lived downstairs from us until they made aliyah in, I think, 1962. His children remain our dearest friends.) ANOTHER REASON FOR THE TORAH URGING THE PURSUIT OF CHESED
It would also be appropriate for me to elucidate the comment of the Yalkut on the verse in Psalm_ 17, "Let my Judgment come forth from Your presence." “Rabbi Levi said: The Holy One, blessed be He, said to David. ‘Havc you set up a Sanhedrin to no purpose? Let them try you.’ David answered Him: Master of the universe, You have written down in Your Torah (Exod. 23.8), ‘You shall take no bribe.’ They (the Sanhedrin) would be afraid to be guilty of accepting bribes when they try me. But You permit Yourself to be bribed, as it is said (Prov. 7.23), ‘He shall accept the bribe from the bosom of the wicked.’ And what is the bribe? —teshuvah, which the Holy One blessed be He receives from the evil-doers in the world, and also good deeds." The Holy One blessed be He said to Israel: My sons! Repent while the gates of teshuvah are still open, for I shall accept bribes offered in this world, but not when I shall sit in judgment in the world to come, of which it is said (Prov. 6.35). ‘He will not favor the offerer of bribes.’ ” It seems strange at first sight. What connection can  there be between repentance and good deeds on the one hand and bribery on the other? If repentance should, by right, be ineffective in the world to come, what has this to do with bribery? Is not God, the God of truth? The answer is that there are two factors by which God controls the world from above: the middoth of Justice. and of kindness and compassion. Now it is known that mans rewards and punishments in the world to come will be determined by the balance of his mitzvoth against the sins he had committed, as Chazal have asserted: “If the majority of a man‘s deeds are righteous, he belongs in the category of Izaddik: if iniquitous, he belongs in the category of rasha'.” Every intelligent person understands that once God takes His seat on the throne of justice during a trial, then even a man whose merits were exceedingly numerous would leave the Heavenly court condemned (unless he had strained with all his might to fulfill all the mitzvoth in all their details). Every one of his mitzvoth would be subjected to meticulous scrutiny to determine whether it had conformed to every requirement of the law. Even what is normally hidden from view (the nature of his mental attitude at the time) would also be most carefully examined for the proper love. awe and joy at its performance, and the other factors which are detailed in the Sefer Charedim, and as Scripture declares (Eccl. 12.14): “For God shall bring every work into the judgment concerning what is hidden . . ." Certainly He would find many mitzvoth the require ments of which were not completely fulfilled. and these would he excluded from the account. Then consequently. the person's iniquities would outnumber his good deeds and he would. God forbid. be designated a rasha, in heaven. Even had he repented of certain sins, his teshuah would be found. under scrutiny. to have been inadequate. However. if the Holy One blessed be He then decided to deal with man in accordance with His attribute of chesed and compassion — although it would. certainly. make a great difference whether all the dictates of the mitzvah were obeyed or whether some details were overlooked — nevertheless some redeeming feature would be found for his improper performance, and his merits would not be rejected. It is even conceivable that a person’s iniquities might outnumber his meritorious acts. Yet if God were to exercise the full measure of His compassion. the suns would be reduced in number. Assuredly many of them could be termed unintentional or ascribed to some extenuating circumstance. Then if these would be deducted from the iniquities. the person's merits would outweigh his faults and the name tzaddik would be assigned to him. Certainly If he had repented of his misdeeds. his teshuvah would be accepted, imperfect as it it may have been.
Of course every person would like God to treat him with kindness and compassion. Yet these divine attributes themselves are so exercised that they accord with the principles of Justice. In so far as man‘s conduct in this world exemplifies these characteristics, so does he attract the corresponding attributes towards himself from their Heavenly sources. If. in his dealings with others. he is accustomed to act according to these middoth he calls forth the Divine attributes of mercy. and then God has compassion on the world for his sake. of necessity. man‘s soul is fed by the fruits of his conduct. Hence he deserves that God extend the some consideration to him when he stands in need of compassion. As Chazal have declared (Shabbath 151b): “Everyone who has compassion on his fellow creatures. is himself granted compassion by Heaven." So the holy Zohar expresses it (Sidrah Emor): “The act below stimulates a corresponding activity above If a man performs a worthy act on earth. he awakens the correspending power above. Thus if a man does kindness on earth, he awakens chesed above, and it rests on the day which is crowned therewith through him. Similarly if he performs a deed of mercy, he crowns that day with mercy and it becomes his protector in the hour of and . i . giving him measure for measure. Happy is the man who exhibits the proper conduct below since all depends on his act to awaken the corresponding activity above.“

If during his lifetime a person was in the habit of not foregoing anything of his own. of not having pity on others, he reinforces the attribute of Heavenly justice. So afterwards. when he is in need of such benefits. he is paid back with his own attitude. God deals with him with that attribute. This is the idea expressed in Isaiah (3-10): “Say of the righteous that it Will be well with him; for they shall eat the fruit of their doings. Woe unto the wicked! It shall be ill with him, for the work of his hands shall he done to him.“

Here then is what Chuzal intended to convey by declaring that the Holy One, blessed be He, accepts repentance and good deeds as bribes. “Good deeds” refer to the charity and chm-(I which one dispenses in this world. These acts cause one‘s repentance to be accepted in Heaven. even if it is inadequate from the point of view of pure justice. By his good deeds the person has drawn the Divine attributes of chased and rachamim (compassion) towards himself while he is still alive. And so the very attribute of justice itself is inclined to treat him with chesed-- to give him full credit for his repentance and all his mitzvoth. Now we can appreciate why. throughout the Torah, God may He be blessed, pressed man to embody this trait. for as is well known from Scripture (Micah 7.18). “God desires lovingkindness." Hashem's desire is that the people be vindicated in their trials in the time to come and not, God forbid. be declared guilty. Therefor, many times over in the Torah. He commanded them to follow in all His ways. the paths of goodness and kindness. so that He will be able. in the end, to conduct Himself towards them in accordance with this middah. 

The Noda BiYehuda- 
 והנה מה שביקש מעלתו ממני לסדר לבעל תשובה זה תשובה על עונו והזכיר שהוא אדם חלוש מאוד לא יסבול קושי התעניתים וסיגופים גם הזכיר נפלאות מהתמדת לימודו יומם ולילה ואינו שח שיחה בטילה כלל ואינו שוכב בלילה במטה כלל. הנה הקשה לשאול ממני דבר קשה שאיני רגיל להשיב לשואל ממני שאלה בדבר שלא אוכל למצוא שורש בדברי הגמי והפוסקים כי לא מצינו בכל התלמוד מספר התעניות ימים חרוצים וקצובים לכל חטא ואשמה כפי חומר העון. הן אמת שצום כתיב בפסוק בנביאים לצורך התשובה שובו עדי בצום וגוי. אמנם הגבלת מספר התעניתים לא נתפרש לא בכתוב ולא בגמרא רק שספרי המוסר והתשובה האריכו בזה ורוב דבריהם בנוים על סברות כרסיות בלי שורש וספר אחד נשען על חבירו בלי יסוד כלל. ומצינו בזה הרבה חומרות והרבה קולות ולכן קשה עלי להשיב בזה, וביחוד אחרי רואי שהבעל תשובה עצמו הוא צורבא מרבנן יסדר הוא לעצמו הלא כל ספרי המוסר והתשובה מצויים ביד כל אדם. אמנם אחרי אשר מעלתו מפציר בזה והאיש הוא צורבא מרבנן ואיש חלוש לכן לא אמנע מלדבר קצת בזה
הנה עונו גדול מנשוא מצד חומר העון עצמו עון אשת איש ובפרט שהתמיד בחטא זה שלש שנים רצופות והיה עמה בבית ושכיחא ליי בודאי שאין מספר לרוב פעמים שבא עליה ולא יספיקו לו שנות מתושלח למספר התעניות בתשובת המשקל לפי תשובות הרוקח שדבריו דברי קבלה ואין לדמות דבריו לדברי האחרונים. ומה שהמציא בעל קנה חכמה תקנה לשבים שדי אם יעשה תשובת המשקל על אותה עבירה שלש פעמים דבר זה אין לו יסוד ואטו מי שעבר עבירה שיש בה מלקות כי פעמים והתרו בכל פעם מי סגי לו בגי פעמים מלקות והלא הב״ד מלקין אותו לפי מספר ההתראות ומשנה ערוכה אמרו לו אל תשתה אל תשתה חייב על כל אחת ואחת וארישא קאי שהיה שותה כל היום. ומה שלקח סמוכים שבפעם השלישית כבר נכתם עונו בנשמתו מעבר לעבר ואין מקום לחטא הרביעי לחול דבר זה אין לו שחר ואטו בנשמתו לבד פוגם והלא פוגם למעלה וכשארז״ל ותשכח אל מחוללך. ולא עוד לו יהיה כדבריו עון עצמו אינו נמחק וכל אחד רווחא שביק וכאשר שב על הראשונים חלו האחרונים, וכעין שארז״ל במסי שבועות דף כ״ז ע״ב חיובא הוא דליכא הא שבועה איכא דאי משכחת רווחא חייל שאם נשאל על הראשונה חיילא שניה. ואין דרכי לעיין בספרים הללו רק קצת אני זכור מילדותי. אלא שאומר אני כל זה אם היה התענית דבר המעכב בתשובה אבל באמת אין התענית רק דבר טפל לתשובה, ועיקר התשובה הוא עזיבת חטא וידוי דברים בלב נשבר חרטה בלב שלם התקרבות והתלהבות לאהוב את הבורא והיינו תשובה שישוב אל הי וירחמהו, וישוב אל הי היינו שידבק בו אבל שאר דברים תענית וסיגופים אינם עיקרים. ותדע הרי זה בלתי ספק שהתשובה מכפרת כפרה גמורה ודבר זה מפורסם בתורה ונביאים וכתובים ובשני התלמודים ובכל המדרשים והנביא אומר (יחזקאל יח) ובשוב רשע מרשעתו וגוי (שם לג) כל חטאתיו אשר חטא לא תזכרנה לו וגוי. וגם זה אין ספק בו בזמן שסנהדרין היה נוהג אם עבר על חייבי מיתות ב״ד אחר ההתראה אף אם שהו עדים ולא באו לבית דין שנים רבות ובין כך עשה זה תשובה והרבה סיגופים ותעניות לאין מספר יותר ויותר מתשובת המשקל הנזכר ברוקח ושוב אחר כל התשובה באו עדים לב״ד והעידו הא ודאי שאין הב״ד משגיחין על תשובתו ושורפין וסוקלין לפי עונש החטא, והדבר יפלא כיון שודאי שהתשובה הועילה וכבר סר עונו וחטאתו נתכפרה למה יומת ונקי וצדיק אל תהרוג כתיב. ובהדיא אמרו בריש אלו הן הלוקין חייבי מיתות עשה תשובה אין בית דין מוחלין לו. אלא ודאי גזירת הכתוב הוא שאלמלא כן בטלו עונשי תורה בכללן ואין אדם שיומת בב״ד כי יאמר חטאתי והנני שב וכיון שהקב״ה רצה ליתן עונש מיתה על קצת עונות כדי שיתיירא האדם מלעבור לכן נחוץ הוא שלא תועיל התשובה להציל ממיתת ב״ד. ואי ס״ד שתשובת המשקל הוא עיקר בתשובה א״כ ודאי שנאמר למשה מסיני כל עון ואשמה משקלה ומשקל תשובתה לפי ערכה, ומעתה למה לא יועיל תשובה להציל ממיתת ב״ד ואעפ״כ כל עונשי מיתת ב״ד לא יבוטלו דנחזי אנן אם סיגף עצמו לפי משקלו ובפרט שהרבה סיגופים יש שאין להערים כגון לישב ערום בפני הדבורים וגלגול שלג וכיוצא מהנזכר בספרי התשובה ומי שלא עשה לפי משקלו יומת בבית דין, וגם בתענית אין להערים שאם העדים יבואו תיכף לבית דין יומת שהרי עדיין לא התענה. ואין לומר דאכתי היו בטלים כל עונשי ב״ד משום דבשעת התראה הוא ספק פן יעשה תשובה והוה התראת ספק, הא ליתא דמן הסתם העדים יביאוהו תכף לב״ד, ועוד תינח למ״ד התראת ספק לא שמה התראה אבל למ״ד שמה התראה וכן קיימ״ל מאי איכא למימר, אלא ודאי שאין לסיגופים ותעניות עיקר מן התורה ועיקר התשובה הוא חרטה גמורה. וזה יכול להיות ברגע אחד ואם אתה אומר שתשובה תציל ממיתת ב״ד בטלו כל דיני מיתות ב״ד. ואף שבארבעה חילוקי כפרה ארז״ל שאם עבר על כריתות ומיתות ב״ד תשובה ויוה״כ תולים ויסורים ממרקים הרי שהיסורים עיקר הכפרה ואי אפשר לגמור הכפרה בלי יסורים. אומר אני הן אמת שצריך יסורים אבל כבר ארז״ל עד היכן תכלית יסורים אפילו הושיט ידו לכיס ליטול שלש ועלו בידו שתים עיין שלהי פרק יש בערכין, הן אמת שדברי הרוקח דברי קבלה והרי הוא נתן תשובת המשקל, אומר אני שודאי נחוץ הוא לבעל תשובה כדי לשבור לבו הזונה שיוכל להתחרט בלב שלם וכל זמן שלא נשבר לבו אי אפשר להיות החרטה בלב שלם בלי ערמה וכל זה מן הסתם. אבל מי שיוכל לזבוח יצרו ע״י התורה שכבר העידו חז״ל שאם אבן הוא נמוח וגם התורה מתשת כח לזה אני מיקל מאוד בתענית וסיגופים אבל החרטה ושבירת הלב והבכי זה נחוץ מאוד והמרבה בבכי במסתרים משובח. והנה בעיקר התשובה כבר אני רואה באיש הזה דבר גדול שהזכיר מעלתו במכתבו שלא יסף לדעתה מיום חתונתו שנתים ימים והיה עמה בבית. והנה רז״ל אמרו בשלהי יומא היכי דמי בעל תשובה אמר ר״י שבאתה דבר עבירה לידו פעם ראשונה ושניה וניצול ממנה מחוי רב יהודה באותה אשה באותו מקום באותו פרק, וזה נתקיים באיש הזה. אמנם עם כל זה לא תזוח דעתו עליו שאף שנתקיים באותה אשה באותו מקום אבל באותו פרק לא נתקיים ולא יתקיים שהרי בשעת החטא היה רווק ועתה יש לו אשה ויש לו פת בסלו, וגם איני יודע אם מה שלא יסף לדעתה הוא מחמת תשובה או אולי היתה אשתו מצויי ולא היה לו שעת הכושר לחטוא פן תרגיש בהם אשתו.

 אמנם מה שהזכיר מהתמדת למודו נפלאות וגם שברון רוחו ושמירת פיו ולשונו מדברים בטלים, כבר יש לו יסוד גדול לסמוך עליו. ויקיים וידוי דברים לקיים וחטאתי נגדי תמיד ויתודה ויתחרט. והנה צריך להתודות על חטא קטן אפיי מדברי סופרים שעבר שהרי כיון שזנה עם האשה קודם החתונה היה אסור לישא בתה כמבואר ביבמות ריש פרק נושאין על האנוסה הן אמת עתה שכבר כנסה לא יוציא כמבואר בהרמב״ם ובש״ע אה״ע סיי ט״ו סעיף י״ג מ״מ תחלת הנשואין עבר אדרבנן וצריך חרטה גם צריך להרחיק חמותו מביתו שלא תבא לביתו כלל שאם תרגיל לבא לבתה צריך לגרש את אשתו לפי דעת הרמ״א שם בסעיף כ״ז וק״ו שלא ידור בבית חמותו. וכבר ארז״ל חתן הדר בבית חמיו וכוי ק״ו זה שכבר נכשל בה.

 והנה אף שאני מיקל בתעניות וסיגופים ותשובת המשקל לזה האיש אבל פטור בלא כלום אי אפשר בפרט לפי רוב התמדת החטא. 

והנה התמדת התורה הוא עיקר. אמנם ילמוד דברי תורה שיש בהם ממש משניות בעומק העיון עם תוסי יו״ט ש״ס ופוסקים ותורה נביאים וכתובים וג״כ ספרי מוסר חובת הלבבות מן אחר שער היחוד עד גמירא ושל״ה במקום שאינו מדבר בנסתרות והלכות תשובה ברמב״ם. וידבק מאוד בשירות ותשבחות של דוד המלך ע״ה שזה דבר גדול להלהיב בלב האדם אהבת הבורא ב״ה. אבל שאר תפלות ותחנונים אשר חדשים מקרוב דורות מעוטים לפני דורנו ירחק מהם ובאתר דליעול ירקא ליעול בשרא וכוורי הם שירותיו של דוד שבודאי מועילים, ובכל חצות הלילה ירבה בבכי על החורבן ועל הגלות. והואיל והוא אדם חלש ומתמיד בתורה לא יתענה בקיץ בזמן החום ביותר כמו תמוז כלל רק בערב ר״ח, ושאר ימי הקיץ יתענה בכל שבוע יום אחד מלבד באלול יתענה כל שבוע בי או גי פעמים לפי כחו ובעשי״ת יתענה יום ויום ובימי החורף מן תחלת חשוון עד ר״ח ניסן יתענה בכל שבוע שלשה ימים ובתוכם יום אחד שלם לילה ויום. ככה יתנהג שלש שנים רצופות ואם ירגיל לקיים חצות לילה אקום ולא יעבור עליו חצות לילה בשינה ויהיה עומד על משמרתו עד אור היום ולאו דוקא עומד הה״ד יושב רק שלא יבטל מתורה ותהלים מחצות עד אור היום אזי יכול להקל על עצמו קצת מהתעניות ויתענה רק שני ימים בכל שבוע בחורף.

 יתר סגופים כבר הזכיר מעלתו שאינו שוכב על מטה כלל ודי בזה. ירחיק משחוק שלא ישחוק שלש שנים הללו אפילו שלא ימלא פיו ולשמחה מה זו עושה והוא יתאבל על עונו. לא יסתכל בנשים ויהי שח עינים. כל שלש שנים הללו כל ימי השבוע לא ישתה יין ולא יין שרף ולא משקה המחמם רק טעע עם צוקר יכול לשתות ולפעמים מעט קאפע. בליל העונה רשאי לשתות אף משקים הנ״ל, ואופן עונתו אינני מסדר לו כי אינו רשאי לגזול עונת אשתו וגם לפי מזגו אם הוא חם או קר בטבעו ויסדר לעצמו בגדר האמצעי ואינו ראוי להחמיר על עצמו יותר מדאי במותר לו וכבר אמרו חז״ל שמאל דוחה וימין מקרבת. ומה טוב שלא יבטל מטבילת קרי. אחר כלות שלש שנים ראשונות בשלש שנים שניות יתענה בחורף בי והי ובקיץ יתנהג כראשונות, ורשאי בגי שנים שניות לשכב על מטה מוצעת כרצונו וכפי כחו. ושוב כל ימי חייו יתענה בכל חורף בכל שבוע יום אי ובקיץ ער״ח לקיים וחטאתי נגדי תמיד ובין ר״ה ליוה״כ בימי התשובה יתענה בכל יום.

 ואחר שהזכיר מעלתו שהוא עתיר נכסין מאוד ירבה בצדקה וחטיך בצדקה פרוק. ומה טוב אם יחשוב תשובת המשקל של הרוקח ואין ספר הרוקח כעת לפני יעיין בעצמו מספר ימי התענית הקצובים שם לאשת איש ואולי גם מספר ימי תענית נדה כי בודאי לא נזהר בה גם בימי נדתה. ויכפיל המספר שלש פעמים לפי דעת הקנה חכמה ומספר הימים שיעלה סך הכל יפדה בצדקה עפ״י חשבון המבואר בא״ח סוף סיי של״ד בעד כל יום סך שנים עשר פשוטים וי״ב פשוטים עולה ח״י צ״ל עפ״י חשבון המבואר שם במג״א ס״ק ל״ד בשם תה״ד וסך הכל שיצורף בחשבון יחלק לצדקה אם אפשר לו בלי הקפדת אשתו, ואעפ״כ יקיים מספר התעניתים אשר קצבתי לו, והוא רחום יכפר עון וסר עונו וחטאתו תכופר

See also the Maharit in 2 OC 8 on this topic- he says that the kapara of teshuva is complete without anything else, and he deals with the Gemara in Chagiga that calls having a mamzer a מעוות שלא יוכל לתקון.

However: Reb Moshe, in the teshuva I cited above, says that Teshuva alone is sufficient for sins other than those that are more egregious.
אך שאף שנחשב בעל תשובה מ"מ הא לענין כפרה שימחוללו הקב"ה מפורש (פ"א מתשובה ה"ד) דאיכא שני חלוקי כפרה שלא מתכפר בתשובה ויו"כ אלא צריך יסורין לחלוק הג' דהוא כריתות ומב"ד ומיתה לחלול השם מסתבר דאין לנו בזה אלא מה שנאמר דהוא כריתות וחייבי מב"ד ולא חייבי מיתה ביד"ש

I heard in Rav Yosef Ber's name that tzedaka helps train a person to abandon his sinful ways, and it therefore essential to teshuva. He says that sin stems from selfishness. If a person were aware that his there are more important things in life than to satisfy his infantile and selfish desires, he would never sin. His awareness of the omnipresent glory of the Ribono shel Olam, and his duty as an eved Hashem, would eliminate his desire for momentary and superficial satisfaction.   The best trainer for this discipline is finding poor and helpless people and taking your time and money and resources and giving it to them. This will break you of your selfishness and teach you that there are far more important things to be done with our lives than endless pursuit of personal pleasure.


My brother, Shlitah, said that, as the Mesillas Yesharim says, the creation of the world was the ultimate chesed. Sin is the ultimate kefiyas tov. Tzedaka, which enhances the world, is our way of doing what we were created to do, which is the opposite of sin.


Along the same lines- most aveiros stem from Gaavah. A person that gives tzedaka because he needs to do teshuva will enhance his ability to do teshuva shleima, to be machniah himself to the Ribono shel Olam. Again, I want to emphasize that this is a special kind of tzedaka. It is not the usual tzedaka. Of course, the purpose is to help the needy, but it is given in the context, and for the purpose of teshuva. I think that only then does it have the desired effect.

As I would put it, the idea is that by giving tzedaka, you focus on others' well-being, and by doing so, you overcome your preoccupation with your own immediate satisfaction and pleasure. Only then can you gain the perspective and wisdom that widens your horizons to include your own distant future and the benefit of klal Yisrael as a whole. This is "מעביר את רוע הגזירה" in the sense of giving you a perspective that enables you to accept that while some current experience is painful and harrowing, it will ultimately lead to a to'eles, to your part in Kiddush Hashem.

An anonymous comment compressed these thoughts into a few words and also highlighted their common denominator.

In the context of your point about tzedaka negating selfishness , gaavah and ego, perhaps we may note that the Rambam uses the phrase "oseh tzedaka" (not "nosain tzedaka"). A person who "gives" something, does so from (and according to the limits of) the willingness of his heart. But a person who "does" something, does so because of the thing that must be done, not necessarily because of - and limited by - his own will. Thus, the baal teshuvah must force himself to "do" tzedaka, to the limits of his ability, in contrast to his previous disposition of doing whatever HE wanted to do. Of course, putting oneself and one's own will aside to do Hashem's will is the essence of every mitzvah, but for most people this is most brought to the fore when it comes to the mitzvah of tzedaka, since with this mitzvah one is providing one's own resources - which could have been used to carry out his own desires - for the benefit of another. 

This idea, "put yourself aside for the benefit of another-" reminded me of the Rambam's interesting concept that it's not the pshat that humility contributes or enables teshuva. Pshat is that humility itself is the mechapeir.  Why do I say this? Look at the Rambam in Teshuva 2:4

מדרכי התשובה להיות השב צועק תמיד לפני השם בבכי ובתחנונים ועושה צדקה כפי כחו ומתרחק הרבה מן הדבר שחטא בו ומשנה שמו כלומר אני אחר ואיני אותו האיש שעשה אותן המעשים ומשנה מעשיו כולן לטובה ולדרך ישרה וגולה ממקומו. שגלות מכפרת עון מפני שגורמת לו להכנע ולהיות עניו ושפל רוח:

The Rambam doesn't say that Galus is mechapeir because it brings about or enhances the mindset that is necessary for Teshuva.  He says שגלות מכפרת עון מפני שגורמת לו להכנע ולהיות עניו ושפל רוח- that the galus is mechapeir because it causes anivus and shiflus ruach.
This is besides the Rambam's general instruction that Gaava, even the smallest amount, conflicts with teshuva, as he says in the next halacha-
וכל המתגאה ואינו מודיע אלא מכסה פשעיו אין תשובתו גמורה שנאמר מכסה פשעיו לא יצליח.
In Halacha 4 he is saying that it is gufa the hachna'ah and shiflus ru'ach that is the mechapeir.  If so, it is very yitachein that the benefit of tzedaka given for the purpose of teshuva also has this effect.

  3. I wonder if giving tzedaka and kappara are more intrinsically related. Doesn't the gemara say that a poor person is like someone who is dead? Meaning the possessions of a person are not just something extrinsic to who a person is, but it is actually part of who the person is and his existence. And therefore, when I give up my money or my possessions I am in a sense offering up a part of myself, losing a bit of my life so to speak. And that is what causes the kappara, although the "sacrifice" is channeled to an ultimate good by redirecting it to someone poor (and therefore following in Hashem's ways) and not just being mashchis those possessions.
