Teshuva, Tefilla, and Tzedaka. Tzedaka's Role in Teshuva

Introduction 
Chazal and the Rishonim and the Achronim make it clear that Tzedaka has a role in Teshuva. We are going to analyze the relationship of Tzedaka to Teshuva. But please, do not lose sight of the forest for the trees. Do not let the Yetzer Hara cheat you out of an effective and meaningful Teshuva. Shedding tears and sincerely klapping Al Chet is not enough. You need to remember that Tzedaka is a vitally important part of Teshuva.
I am very grateful to Harav Shimon Kalman Goldstein for bringing up this excellent question. Remarkably, I have found almost nobody talks about it.

Let's put Unesaneh Tokef to the side for a moment.  The Rambam in the second perek looks at Teshuva from three perspectives

2:1 - 
אי זו היא תשובה גמורה. זה שבא לידו דבר שעבר בו ואפשר בידו לעשותו ופירש ולא עשה מפני התשובה.
What is "Complete Teshuva"? When the opportunity to sin presents itself and he rejects it.

2:2 and 3 - 
ומה היא התשובה הוא שיעזוב החוטא חטאו ויסירו ממחשבתו ויגמור בלבו שלא יעשהו עוד שנאמר יעזוב רשע דרכו וגו'. וכן יתנחם על שעבר שנאמר כי אחרי שובי נחמתי. ויעיד עליו יודע תעלומות שלא ישוב לזה החטא לעולם
What is (the process) of Teshuva? Leaving the sin, not thinking about how nice it would be to sin, a decision to never sin, and regret for the past. The resolution has to be so firm that God Himself will testify that he will never do this sin again. 

כל המתודה בדברים ולא גמר בלבו לעזוב הרי זה דומה לטובל ושרץ בידו שאין הטבילה מועלת לו עד שישליך השרץ. וכן הוא אומר ומודה ועוזב ירוחם. וצריך לפרוט את החטא שנאמר אנא חטא העם הזה חטאה גדולה ויעשו להם אלהי זהב:
Teshuva requires Vidui. Vidui must specify what sins you are doing teshuva for, and it must verbalize an absolute resolution to never sin again.

2:4 - 
מדרכי התשובה
להיות השב צועק תמיד לפני השם בבכי ובתחנונים 
ועושה צדקה כפי כחו 
ומתרחק הרבה מן הדבר שחטא בו
ומשנה שמו כלומר אני אחר ואיני אותו האיש שעשה אותן המעשים ומשנה מעשיו כולן לטובה ולדרך ישרה וגולה ממקומו. שגלות מכפרת עון מפני שגורמת לו להכנע ולהיות עניו ושפל רוח:
The "Ways of Teshuva" are tearful prayer, Tzedaka to the extent he is able, rigorous avoidance of the opportunity to sin, changing his name (as if saying "I am no longer that sinful man, I am a different person,") and exile (because exile brings forgiveness by making a person feel humble and lowly.) 

Here the Rambam has introduced something new. 
He told us what proves full Teshuva in 2:1. 
He already told us how to do Teshuva in 2:2 and 3. 
What is he telling us now in 2:4? What does that mean, מדרכי התשובה? What is the meaning of "the ways/paths/behaviors of Teshuva?" Is it part of Teshuva or not?

In the next perek, 3:4, he says the specific association of Tzedaka with Teshuva is common knowledge and universally observed.
....לפיכך צריך כל אדם שיראה עצמו כל השנה כולה כאילו חציו זכאי וחציו חייב....עשה מצוה אחת הרי הכריע את עצמו ואת כל העולם כולו לכף זכות.....ומפני ענין זה נהגו כל בית ישראל להרבות בצדקה ובמעשים טובים ולעסוק במצות מראש השנה ועד יום הכפורים יתר מכל השנה.....

The Rambam's association of Tzedaka with Teshuva and Kapara appears in many places in Tanach and Chazal, which is why it is common knowledge. 

We know this from the words of the Navi Yeshaya (58,) 
הכזה יהיה צום אבחרהו יום ענות אדם נפשו הלכף כאגמן ראשו ושק ואפר יציע הלזה תקרא צום ויום רצון לה'
הלוא זה צום אבחרהו פתח חרצבות רשע התר אגדות מוטה ושלח רצוצים חפשים וכל מוטה תנתקו

הלוא פרס לרעב לחמך ועניים מרודים תביא בית כי תראה ערם וכסיתו ומבשרך לא תתעלם

אז יבקע כשחר אורך וארכתך מהרה תצמח והלך לפניך צדקך כבוד ה' יאספך

And from what Daniel told Belshatzar in Daniel 4,
לָהֵן מַלְכָּא מִלְכִּי יִשְׁפַּר עליך [עֲלָךְ] וחטיך [וַחֲטָאָךְ] בְּצִדְקָה פְרֻק וַעֲוָיָתָךְ בְּמִחַן עֲנָיִן הֵן תֶּהֱוֵא אַרְכָה לִשְׁלֵוְתָךְ׃

Tzedaka figures prominently in the idea of Teshuva and Kapara.  But why? We all understand that Teshuva brings Kapara. What does Tzedaka have to do with Teshuva and Kapara?

Is it because כל המרחם על הבריות מרחמין עליו מן השמים so it protects from punishment, or does it somehow erase the aveira, as Teshuva does? Is it direct, or indirect? Is it for Teshuva, or is it for Kapara, or is it for Ritzui?

In proper English: Punishment for a crime, or a sin, might be avoided in two ways - Pardon and Expungement.  A Pardon grants forgiveness. It does not erase the event, it only means that the person, or the society, that had a claim against the malefactor no longer seeks to punish or penalize him. Expungement, on the other hand, erases the criminal act. It is as if the event never occurred. 

Here is a perfect example of what being a Baal Chesed can do. In some cases, after a person has been found guilty, the judge has discretion in determining the sentence. Often, a judge will allow letters of character to be submitted to the court, and such letters can carry substantial weight in his decision. He might mitigate the sentence significantly, or at least incline toward the lower end of the sentencing guidelines.

By Aveiros, it would be a great chesed if the punishment alone were removed or mitigated, and that is what comes to mind when we think about the Rachamei Hashem that is evoked by Tzedaka.  The avaryan, through showing mercy to others, is shown mercy as well, and the punishment he earned is mercifully set aside. 

When we talk about Teshuva, we think about Expungement, מריקת ועקירת החטא. Tzedaka and Chesed, on the other hand, would seem to have an effect of Pardon, הגנה מן היסורין וכפרה. So in what way is Tzedaka related to Teshuva?

Besides the very important difference in hashkafa, here's another obvious nafka minah. If it's because כל המרחם, then it falls under the regular rubric of Tzedaka, and so the usual rule of אל יבזבז would apply. If it is directly related to the din of teshuva, then the idea of צדקה כפי כחו  would mean he should do whatever is possible for him to do in order to get kappara, and אל יבזבז would not apply.
Poskim do discuss this issue, of whether אל יבזבז applies in this case. I have not seen any that make what seems to me to be a clear cut tliyah.

I have organized the answers into FOUR basic approaches. There are important variations within each.

1. Tzedaka is an adjunct to Teshuva. 
          A. Tzekada is completely unnecessary for Teshuva for most sins because Teshuva alone is effective. Only in special cases, where Teshuva alone is not sufficient to eliminate the consequences of the sin, (i.e., Kareis and Missas Beis Din,) will Tzedaka become necessary as a "booster," or a supplement.  This is clearly not like the Rambam who applies it to all cases.
         B. Special effort for Tzedaka is an "echo" that follows Teshuva - that Teshuva ought to create a special desire for Ritzui and Dveikus (perhaps to bring you closer to the darga of תשובה מאהבה,) and the way to bring that about is through Tzedaka.
(Rabbeinu Yona in Sha'arei Teshuva and Peirush on Mishlei; (brought below, preceding the numbered answers).)  

2. Tzedaka is the vital prerequisite to Teshuva. It is not itself Teshuva, but it is an essential threshold to doing Teshuva. 
The forgiveness brought by Teshuva is not an entitlement.  It is a gift granted when Hashem acts with Middas HaRachamim. Only a person that is himself a rachaman is granted Middas HaRachamim.  (In a range of variations - Chafetz Chaim in Ahavas Chesed and as quoted by Rav Friedlander in Sifsei Chayim (Section I of End-Note), the Netziv in Ki Savo (1), and the Leket Yosher (4).)

3. Tzedaka is a part of Teshuva - it helps erase the aveira.
A. Because giving Tzedaka nullifies the apikorsus that lies at the root of every aveira. It is an antidote to the underlying disease of aveiros. (Harav Shimon Kalman Goldstein  and R Avrohom ben HaRambam (2).)
B. Because it is like a Korban. (Rashi and Rabbeinu Bachaye (3).)
C. Because you can't disentangle yourself from self indulgence and impulsiveness without taking actual steps of selflessness and hispashtus from Gashmiyus through chesed.  (Rabbi Moshe Eisenberg  and R Avrohom ben HaRambam (6).)
D. The effect of an Aveira on your soul depends on the purity of your soul. An essential purity will protect you the Tuma effect of the Aveira.  (Section II of End-Note, from Sifsei Chaim.)
E. Teshuva alone does not erase the sin of the past. That requires either Teshuvas HaMishkal, or that you learn Torah and do Gemillus Chasadim. Torah and Gemillus Chasadim, as part of Teshuva, are more effective than self-mortification. (The Gaon in his Peirush on Mishlei, (8).)

4. Tzedaka is, in a sense, a part of Teshuva because Teshuva has two steps:  First you must eliminate your wicked past. AFTER eliminating your wicked past by doing Teshuva, you have to re-create your better future self. Creating a "Bein Adam LaMakom Tzadik" while ignoring Bein Adam l'Chaveiro produces a monster, not a Tzadik, and your Teshuva will accomplish nothing permanent, like a זורע ואינו קוצר.

Rabbeinu Yona addresses this question in his Shaarei Teshuva. He says that it is an egregious error to think that Tzedaka is part of what we call Teshuva. If you don't do Teshuva, your Tzedaka will not help you regarding the Aveira at all.  The basic rule is that if you do Teshuva, you will be forgiven, and you don't need to do Tzedaka. BUT there are certain grave sins (חייבי כריתות ומיתות בית דין) which Teshuva does not have the power to completely erase. In those cases, and only AFTER a complete Teshuva, Tzedaka will do what Teshuva alone could not do and will bring about a complete Kapara.  
העיקר הי"ז
לרדוף פעולת החסד והאמת. כענין שנאמר (משלי טז) בחסד ואמת יכופר עון וביראת ה' סור מרע. ועתה התבונן בסוד המקרא הזה. כי האמנם אם החוטא לא שב אל ה'. לא יתכפר עונו בפועל החסד. כמו שנאמר (דברים י) אשר לא ישא פנים ולא יקח שוחד. ופירשו רבותינו זכרונם לברכה לא יקח שוחד מצוה. למחול ולהעביר על העונות. ועוד אמרו כל האומר הקב"ה ותרן הוא יותרו חייו. אבל מאריך אפים. ואם לא ישמעו. ימד פעולתם אל חיקם. אכן זה שאמר שלמה המלך עליו השלום בחסד ואמת יכופר עון. על בעל התשובה דיבר. כי יש עבירות שהתשובה ויוה"כ תולין ויסורין ממרקין. כאשר יתבאר בשער הרביעי. והנה החסד יגן בעד החוטא וישמור עליו מן היסורין. בשגם הצל יציל מן המות. כמו שכתוב (משלי י) וצדקה תציל ממות. ועוד יש עון והוא עון חלול השם. שהתשובה ויסורין תולין ומיתה ממרקת כמו שנאמר (ישעי' כב) אם יכופר העון הזה לכם עד תמותון. והנה כאשר האדם משתדל לתמוך ביד האמת. ויעזור אחריו ויתעורר בדבריו. והופיע אורו לעיני בני עמו. ויחזק ידי אנשי האמת. ונשא ראשם. וכתות השקר ישפילם יגיעם עד עפר. הנה אלה דרכי קדוש ה'. והוד והדר לאמונתו ועבודתו בעולם. ועוז ותפארת במקדש תורתו. על כן בהרבות פעליו לקדש את ה' ולעורר האמת להכין אותו ולסעדו. ונסלח לו מעון החלול עם התשובה בשומו האמת לעומת אשמת החלול. מדת תשובתו נגד מדת משובתו. זה ביאור בחסד ואמת יכופר עון:

Rabbeinu Yonah says that בחסד ואמת יכופר עון only means that if a person has done Teshuva, but it's one of those sins for which Teshuva alone is not enough - a sin for which only Teshuva plus suffering brings forgiveness - then Chesed can protect him from suffering. It is a Teshuva booster, where Teshuva can't work on its own.

Rabbeinu Yonah in Mishlei says two answers. First he says that Chesed after Teshuva brings extra Ritzui, it brings you closer to Teshuva Mei'Ahava. Then he says exactly what he said in Shaarei Teshuva.
רבנו יונה, משלי ט״ז ו
בחסד ואמת יכפר עדן וביראת ה' סור מרע.

אין כפרת עון בלתי תשובה וגם אחרי שובו מרעתו צריך לשית עצות בנפשו שיתכפר עונו כפרה שלמה ואם אמנם כל תשובה מועלת להציל מאבדן הנפש אך לפי דרכי התשובה יתרצה אל הבורא יתברך ויתעלה לקרבו ולתת חלק לנפשו בנעימים בעולם הבא ולמחות כעב פשעיו ונקה האיש מעון כאלו לא חטא מיום הולדו ונשארו צדקותיו בידו ושכר מצותיו בידו, ויש תשובה (he means tshuva mei'ahava) תעדיף שכר מלבד מה שתמחה העון. 
עוד דרך שנית בענין העברת העונש בעולם הזה. כי יש עון התשובה כפרתו ויסורין ממרקין אותו, ויש אשר תשובה ויסורין תולין ומיתה ממרקת. ולהעברת העונש בעולם הזה תועיל תועלת עצומה גמילות חסדים מלבד מה שהקרן קיימת לו לעולם הבא כמו שנאמר מתן בסתר יכפה אף (להלן כא י) ודרשו ז"ל אם יתכפר עון בית עלי בזבח ומנחה (שמואל א ג יח) בזבח ומנחה אינו מתכפר אבל מתכפר בתשובה ובמעשים טובים וכאשר יעיד המקרא הזה כי בחסד ואמת יכופר עון 


The language of the Rambam is not compatible with Rabbeinu Yonah's approach in Shaarei Teshuva. Rabbeinu Yonah's Tzedaka is limited to a certain category of sins, while the Rambam applies Tzedaka kefi Kocho universally, as a yesoidesdikkeh cheilek (a sina qua non) of the עקירת החטא aspect of Teshuva.

It is possible to put Rabbeinu Yonah's first answer in Mishlei into the Rambam. The Rambam talked about that the Chesed and Tefilla after Teshuva as being מדרכי התשובה, and Rabbeinu Yonah says
 ואם אמנם כל תשובה מועלת להציל מאבדן הנפש אך לפי דרכי התשובה יתרצה אל הבורא
He sees Tzedaka as an "echo" of proper Teshuva. Proper Teshuva should make the Baal Teshuva desire a special Ritzui to Hashem, to come to a madreiga of תשובה מאהבה.  

It's hard to know. I am not sure they mean the same thing. The Rambam seems to make the Tzedaka a part, or a tnai, of the Teshuva process itself, by equating עושה צדקה כפי כחו and מתרחק הרבה מן הדבר שחטא בו.

1. For the first mehalach, we turn to our parsha.

26:15.  Hashkifah.  The Medrash Tanchuma says that all the ‘hashkifah’s in Chumash are lara’a, except for this one, because matnos aniyim is m’hapeich middas achzorius to middas rachamim.  The Netziv says that Ma’on is where the Malachai Hashoreis are, and we are saying, if you, Hashem, look at your malachim in Ma’on, and they are afraid of the Middas Hadin, then we, earthly people, should be looked upon, from Shomayim, with Rachamim.    The Satmerer in his Vayo’el Moshe here says that the reason we say hashkifa and then say that matonos are m’hapeich l’tov instead of just saying ‘re’ay’ without being m’hapeich, is because the vidui is about mitzvos that we did, but did with less than pure kavana.  But since the aniyim benefitted, the flaw in kavana is less important, and so the hashkifah is changed from achzorius to rachamim.

On the basis of the Medrash and the Netziv, it could be that we do tzedaka and say to the Ribono shel Olam, Hashkifah from Your Ma'on! The Malachei Hashareis in the Ma'on are afraid of Middas HaDin, how much more so are we unable to stand before Middas HaDin. According to Middas Hadin, everything we do is rotten, and our lives matter no more than animals', and Teshuva is not possible.  But we have the zechus of Tzedaka, of Matnos Aniyim, which is me'hapeich Din to Rachamim. With Rachamim, our failures are smaller, perhaps like the Chelbenah, and Teshuva becomes possible.

2.  For the second mehalach, we turn to Harav Shimon Kalman Goldstein.

Harav Goldstein says that the essence of every Aveirah is the attitude that we are our own masters and we can do what we want. This is a form of Avoda Zara, denying the Ribono shel Olam's ba'alus over us. Not giving Tzedaka properly expresses exactly that kind of haskafa of Avoda Zara.  The Ran in Sanhedrin 56b and the Yad Ramah there 57b say that Goyim are chayav in Tzdaka. The Prashas Drachim explains that this is because refusing to give is a statement that what we have is ours, when the truth is that we were given things in order to do what the Ribono shel Olam wants us to do with them, so not giving is a form of Avoda Zara.
In order to do Teshuva, you need עקירת שורש העבירה, to destroy the root of the aveirah. 
When a person gives Tzedaka, as the Rambam says, כפי כחו, not just "yoitzeh zain," he is showing that he knows that he is a gizbar that was given what he has by the Ribono shel Olam, that he is a trustee who was appointed to manage assets at the instruction of the Benefactor, not an ongeshtopteh poritz.  He is recognizing the ba'ilus of the Ribono shel Olam on everything we have, and he is showing that he believes it by doing what he ought to be doing as a Gizbar of his time, his talents, and his money.  

(True, this is in the Rambam, and the Rambam (Melachim 10:10) holds that Goyim are not chayav in Tzedaka, so it's not mamesh Avoda Zara. But the Rambam can certainly agree that a Yisrael that does not give has the shoresh of Avoda Zara.)

Harav SKG later showed me that he was mechavein to R Avrohom ben HaRambam in his Hamaspik, in Sharashei HaNedivus. R Avrohom ben HaRambam does not connect it to Teshuva per se, but the relationship is obvious. He says that Nedivus shows basic Emunah in the Ribono shel Olam.
ודע כי מידה אצילה ונשגבה זו מידת הנדיבות והותרנות מלמדת על האמונה והבטחון ומיעוט השמחה בקניני העולם הזה והבטחון בתוצאות הדעת ואמונת הדת כי הנדיבות בממון וברכוש מלמדת על בטחונו בה' יתעלה שישלם לו חלף ממונו ומיעוט שמחתו בעולם הזה וקניניו החולפים וכי הנפש נוטה לדברים בני אלמוות ולא לדברים בני חלוף והקמצנות בכל אלה מלמדת על היפוכו של דבר 

Nedivus, the willingness to share what you have with others shows that you have faith in Hashem, that you know that what you have is given to you by the Ribono shel Olam, and that if you use it with righteousness and sympathy, you are doing Hashem's will.


3.  We have many places where Chazal say that Tzedaka is mechaper like Korbanos. Korbanos are not merely a machshir to protect us from yesurim, they are the means of erasing the aveiros. If Tzedaka is like a Korban, then the relationship of Tzedaka to Teshuva is like that of a Korban to Teshuva. It's not just a Meigin, it's a mechaper. (Yes, there are korbanos that are only meigin until you bring a kapara, like the Asham Talui. Those are the exceptions to the rule. A normal Korban is a mechapeir, not just meigin from yesurim.)

A. BB 9a:
וא"ר אלעזר בזמן שבהמ"ק קיים אדם שוקל שקלו ומתכפר לו עכשיו שאין בהמ"ק קיים אם עושין צדקה מוטב
Maharsha there-
עכשיו שאין ב"ה קיים אם עושין צדקה מוטב כו'. דאכילת עניים היא תחת אכילת מזבח כמ"ש פתח במזבח וסיים בשלחן בזמן שבהמ"ק קיים מזבח מכפר ועכשיו השלחן מכפר כמפורש בפרק ח"ה ע"ש:
B. Chagiga 27a, Brachos 54b, Menachos 97a:
דכתיב (יחזקאל מא, כב) המזבח עץ שלש אמות גבוה וארכו שתים אמות ומקצעותיו לו וארכו וקירותיו עץ וידבר אלי זה השלחן אשר לפני ה' פתח במזבח וסיים בשלחן רבי יוחנן וריש לקיש דאמרי תרוייהו בזמן שבית המקדש קיים מזבח מכפר על אדם עכשיו שלחנו של אדם מכפר עליו:
What is Shulchano shel Adam?  Rashi-
שולחנו מכפר עליו - בהכנסת אורחין:

Similarly, R Bachay in Kad Hakemach.
וידוע גם כן כי השלחן כנגד המזבח, כי כן דרשו בברכות "והמזבח עץ שלש אמות וגו' וידבר אלי זה השלחן אשר לפני ה'", פתח במזבח וסיים בשלחן, לומר לך כשם שמזבח מכפר כך שלחן מכפר, כי הלחם אשר על השלחן ממנו מאכיל העניים, וכשהוא נותן מלחמו לדל הוא חשוב כקרבן על גבי המזבח



4. From the Leket Yosher, Talmid of the Trumas HaDeshen. By giving to the poor, you are like the Ribono shel Olam's creditor, in a manner of speaking. A creditor has the right to establish the forum for any court case. The Baal Tzedaka can thus request that his case be heard in a Middas HaRachamim court.

והגאון רבי חיים פלאג"י בס' מועד לכל חי סי' יא אות טו אחר שהביא את דברי רבינו החיד"א ז"ל הללו סיים וכתב ואנכי המתאבק בעפרות רגליו הקדושים אבוא אחריו ומלאתי את דבריו אומר מי שחננו השי"ת בעושר ובנכסים אל יראה בעצמו קמצנות ומידת עניות דמורה שהוא כפוי טובה בטובתו של מקום וכמו שאמרו רז"ל והביאו רש"י בפירושו לתורה (דברים ב ז) לפיכך לא תכופו טובתי להראות כאילו אתם עניים אלא הראו עצמיכם עשירים ע"ש ובימים הללו ימי הרצון דאלול ותשרי שהוא הזמן לקצוב מזונותיו אם רואים השמים שה יכול לסבול עניות ואפשר לו להסתפק במועט גם ה' יתן לו כפי שיעורו ולא יותר ח"ו לכן כל היד המרבה לתת צדקה בימים האלה משמיא יהב יהבי ליה על כל פרוטה ופרוטה תרקבא דדינרי אם יתנה בלבב שלם ובלי שום פניה ויוהרא והשי"ת לא ימנע טוב להולכים בתמים עכ"ד יעו"ש

My second thought was to bring in the Maharal on Avos 1:2. Leshitaso, Torah is about our relationship to ourselves in general, Avodah refer to bein adam laMaqom, and Gema"ch is our relationship with others.
And if we divide our avodah this way, then the line from Unsaneh Toqef is an echo of the mishnah. Teshuva repairs the self, tefillah connects us to the Borei, and Tzedaqah, to others.
Which would place tzedaqah in a position where you really can't make the chiluq you're making. It is indeed part of the general picture of teshuvah in that it's standing in for azivas hacheit and qabbalah al ha'asid when it comes to bein adam lachaveiro. And yet it really is also tzedaqah, in the usual sense of tzedaqah.
Thank you, Rav Micha. And here is how I will restate it. (Rav Micha and I use lamakom and l'atzmo differently, and as far as the Maharal's derech, I'm sure that he knows how to read a Maharal better than me. You decide which you prefer.)

The Maharal and the Maharsha (מהר"ל על "דרך חיים" פרקי אבות  פ"א מ"ב, מהרש"א ב"ק ל) say, in several places, that a person duty expresses itself in three ways: בין אדם למקום, שבין אדם לחבירו, ובין אדם לעצמו - a duty to serve Hashem, a duty to serve one's fellow man, and a duty to grow and elevate one's self to the highest possible level.  

(The words of the Maharal:
 ולפיכך אמר התנא האלקי, כי זה עמוד אחד שהעולם עומד עליו הוא התורה, מה שהתורה היא משלמת האדם עד שהוא בריאה שלימה מצד עצמו. ואח"כ אמר על העבודה, והעבודה שהיא עבודה בעצם ובראשונה היא העבודה בקרבנות, ואין דבר יותר ראשון מזה, וכל שאר הדברים שהם עשיית המצות לעשות רצון הש"י נכללים תחת העבודה, רק העבודה היא ראשון וקודם אל הכל, ולפיכך העבודה היא עמוד אל העולם שמזה יחשוב האדם שלם וטוב אל מי שבראו כאשר הוא עובד לו, וצריך שיהיה האדם שלם וטוב לבוראו. וכנגד הג' שצריך שיהיה האדם שלם וטוב עם זולתו, וזהו על ידי גמילות חסדים, כאשר הוא עושה לזולתו חסד חנם הנה אין ספק שבזה הוא טוב לזולתו, ואין דבר יותר טוב מזה כאשר עושה טוב לזולתו בחנם ואז הוא טוב לגמרי:
והנה התבאר לך כי ראוים אלו שלשה שיהיו עמודי העולם, כאשר אלו ג' דברים משלימים האדם עד שהוא טוב בכל ג' בחינות אשר אמרנו, כי אין במציאות רק השם יתב' שהוא מחויב המציאות, והנמצאים שנמצאו מאתו, ובודאי יש לאדם יחס אל בוראו במה שבראו הש"י והאדם נברא ממנו, וראוי שיהיה שומר היחס הזה ואם אין שומר היחס הזה הרי אין בריאתו לכלום, ועוד האדם נברא לעצמו, ואם האדם מקולקל בעצמו ואינו נחשב הרי הוא בריאה של תוהו ואין בו ממש, והשלישי כי האדם הזה אינו יחידי בעולם אבל הש"י בראו עם בני אדם אחרים, ולפיכך צריך שיהיה שומר היחס הזה שיש לו אל שאר בני אדם. לכן אמר שהעולם עומד על התורה ועל העבודה ועל גמילות חסדים, כי על ידי התורה אין האדם בעצמו בריאה של תוהו אבל היא בריאה חשובה, ועל ידי העבודה הוא שומר היחס שיש לאדם אל בוראו שנברא ממנו, ועל ידי גמילות חסדים האדם יש לו חבור אל שאר בני אדם, כי לא נברא האדם בפני עצמו כלל רק עם שאר בני אדם, וכאשר האדם עושה חסד עם זולתו הנה יש לו חבור אל זולתו, ובזה האדם כאשר בראו הש"י, כי לא נברא שיהיה האדם יחידי בעולם, ודבר זה נראה כאשר עושה חסד לזולתו שלא יאמר אין לי עסק עם אחר, ודברים אלו מבוארים. 
The words of the Maharsha:
מאן דבעי למהוי חסידא לקיים מילי דנזיקין כו'. יראה כי חסיד נאמר על מי שעושה מעשיו על צד היותר טוב כמאמרם פ"ק דע"ז במעלות הטוב עשרה דברים זהירות מביאה לידי זריזות כו' וחשיב למעלה עליונה חסידות מביאה לידי רוח הקודש ולפי שיש לאדם במעשיו הטובות ג' חלקים דהיינו טוב לשמים. וטוב לבריות. וטוב לעצמו. קאמר רב יהודה מאן דבעי למהוי חסידא לקיים מילי דנזיקין דאז יכול לתקן מעשיו שיהיה טוב לבריות ורבא קאמר דלקיים מילי דאבות דאז יתקן מעשיו שיהיה טוב לעצמו במדות ואמרי לה דלקיים מילי דברכות דאז יתקן שיהיה טוב לשמים וכל אחד מהני אמוראי נקט כל א' מהני ג' מיני חלוקים במעשים טובים של אדם וק"ל:)

A person that wants to grow, and certainly one who desires to recreate himself, cannot be imbalanced, because imbalance invites failure.  It is not enough to do teshuva by regretting the specific thing one has done wrong. One must vigilantly ensure that he is developing in all respects at the same time.  This is the lesson of תשובה, תפילה, וצדקה.  Teshuva corrects his wrong in relation to the Ribono shel Olam, to make himself  טוב לשמים. To correct the darkness in his own soul, his lack of ruchniyus, the best eitzah is Tefilla, to become טוב לעצמו. Finally, he must remember that one only can be a true human being if he cares for his fellow man, for which one must do chesed, to become טוב לבריות. Teshuva, Tefilla, and Tzedaka; טוב לשמים, טוב לעצמו, וטוב לבריות.  Any one aspect on its own is not real.



6. From Harav Moshe Eisenberg.
Perhaps it means that one who wants to do teshuva should unburden himself from the gashmiyus that surrounds him. This act of giving away enhances his decision to be a more ruchniyusdikkeh person, not a person that is meshubad to gashmiyus and self indulgence. The best way to do this is to give valuable things that he owns to the poor. 
When Harav SKG showed me the Sefer HaMaspik, which supports his mehalach (above in 2,) I saw that it also says exactly like Harav Moshe Eisenberg.  Again, with the relevant words in bold:
ודע כי מידה אצילה ונשגבה זו מידת הנדיבות והותרנות מלמדת על האמונה והבטחון ומיעוט השמחה בקניני העולם הזה והבטחון בתוצאות הדעת ואמונת הדת כי הנדיבות בממון וברכוש מלמדת על בטחונו בה' יתעלה שישלם לו חלף ממונו ומיעוט שמחתו בעולם הזה וקניניו החולפים וכי הנפש נוטה לדברים בני אלמוות ולא לדברים בני חלוף והקמצנות בכל אלה מלמדת על היפוכו של דבר 



7.  From R Dr. Gary Schreiber.
As the passuk teaches us in סור מרע ועשה טוב, it is not enough to regret sin or to avoid sin. One must do positive good as well. Perhaps a Teshuva of removing a negative is incomplete without doing something positive.  If you are seeking a mitzva that is a perfect and universal positive, Tzedaka is perfect. So Teshuva requires Tzedaka as part of the Teshuva process.
To some extent, this is an application of R Micha Berger's pshat.


8. From the Gaon in his Peirush on Mishlei.  
Teshuva alone does not erase any aveiros (maybe it does by Chayvei Asei, but I mean in general.) In order to erase the sin, Teshuva requires one of two additional things: EITHER Teshuvas HaMishkal, purgative self mortification to the degree he enjoyed the sin, OR learning Torah and doing Chesed. The Gaon says that Torah and Chesed are far more effective than suffering. So Tzedaka, according to the Gaon, is part of Teshuva, and helps to erase the Aveira.


פירוש הגר״א, משלי ט״ז ו
בחסד ואמת יכפר עון

כאשר האדם רוצה לשוב אל ה' מן רוע מעלליו, צריך שני דברים, אחד, תשובה על העבר, שני, לקבל על עצמו על להבא לסור מרע. ואמר שעל העבר בחסד ואמת יכופר, שהוא גדול וטוב מכל הסיגופים, לעסוק בתורה ובגמילות חסדים, כמו שכתוב בגמרא (ברכות ה, ב) חסד זו גמילת חסדים, אמת זו תורה ובזה יכופר עונו. ועל להבא אמר עצה לסור מרע, והיינו שישים יראת ה' נגד פניו, שהקב"ה מלא כל הארץ כבודו ועומד עליו ורואה מעשיו המגועלים, ואיך לא יבוש מפניו לעבור על רצונו בפניו ממש.


On this point, it is important to remember the Gemara in Brachos 32b.
וא"ר אלעזר גדולה תענית יותר מן הצדקה. מאי טעמא זה בגופו וזה בממונו:
According to the Gaon, what's pshat in Rebbi Elozer? How can it be that Taanis is greater than Tzedaka? But the answer is already clear in Tosfos there on the previous line, where Rebbi Elozer said that Tefilla is greater than good deeds. Tosfos says that means that Tefilla is greater than GOOD DEEDS WITHOUT TEFILLA.  But Rebbi Elozer is not talking about good deeds TOGETHER with Tefilla.
גדולה תפלה יותר ממעשים טובים. בלא תפלה שהרי משה רבינו ע"ה אף על פי שהיו בידו מעשים טובים הוצרך לתפלה:
Rebbi Elozer is not arguing with the Navi Yeshaya. If so, the Gaon is consistent with the Gemara in Brachos. Of course Tzedaka alone is not as good as suffering. But the Gaon is saying that if a person is properly prepared, if a person is also doing ta'aneisim, then the Tzedaka that he does is greater than the Taanis. Tzedaka without Taanis is lower than Taanis without Tzedaka. But when the Tzedaka comes along with Taanis, then that Tzedaka is itself greater than the benefit of the Taanis.



9. The Ritva in Rosh HaShanna 16b.
The Gemara says 
א"ר יצחק ד' דברים מקרעין גזר דינו של אדם אלו הן צדקה צעקה שינוי השם ושינוי מעשה צדקה דכתיב (משלי י, ב) וצדקה תציל ממות צעקה דכתיב (תהלים קז, כח) ויצעקו אל ה' בצר להם וממצוקותיהם יוציאם שינוי השם דכתיב (בראשית יז, טו) שרי אשתך לא תקרא את שמה שרי כי שרה שמה וכתיב וברכתי אותה וגם נתתי ממנה לך בן שינוי מעשה דכתיב (יונה ג, י) וירא האלהים את מעשיהם וכתיב (יונה ג, י) וינחם האלהים על הרעה אשר דבר לעשות להם ולא עשה
Rashi explains 
שינוי מעשה - שב מרעתו:
The Ritva asks that if it means "not doing rish'us," it doesn't belong here. It belongs in the basic aleph beis of Teshuva. 

שנוי מעשה פירש רש"י שב מרעתו ולא נהירא דהא פשיטא שאם אינו שב מדרכיו כטובל ושרץ בידו הוא שאין מועיל לו שום תשובה 
The Ritva answers that of course, this man already did Teshuva. The Gemara is saying that once you do teshuva, you have to remain forever a Baal Teshuva. The behavior of a Baal Teshuva is to to be constantly vigilant and constantly in search of ways to grow - more than every other person. 
והנכון שאפילו מעשים של רשות שאינם הגונים קצת הוא משנה כלומר שהוא אדם אחר לגמרי ומאי דמייתי תלמודא ראיה מדכתיב וירא האלהים את מעשיהם מייתי ולא מסיפא דכתיב וכי שבו מדרכם הרעה 
This, I believe, is the pshat in the Rambam. Teshuva is A, B, and C. And once you're a Baal Teshuva, then Halacha 4 applies - Darkei HaTeshuva. From now on, your Davenning has to be different, your Tzedaka has to be different, and even how you look at yourself has to be different.

There is a difficulty in the Ritva. The language of מקרעין גזר דינו של אדם is hard to fit with his idea of the higher standard a Baal Teshuva should aspire to. But whatever the pshat is in the Ritva, it fits very well into the Rambam. Clearly, the Rambam's makor is our Gemara, and the Medrashim and the Yerushalmi. They all talk about מקרעין גזר דינו של אדם. Even so, the Rambam chose to call it "מדרכי התשובה

The truth is, so did Rabbeinu Yona in his first teretz in Mishlei - 
וגם אחרי שובו מרעתו צריך לשית עצות בנפשו שיתכפר עונו כפרה שלמה ואם אמנם כל תשובה מועלת להציל מאבדן הנפש אך לפי דרכי התשובה יתרצה אל הבורא יתברך ויתעלה לקרבו ולתת חלק לנפשו בנעימים בעולם הבא ולמחות כעב פשעיו ונקה האיש מעון כאלו לא חטא מיום הולדו ונשארו צדקותיו בידו ושכר מצותיו בידו. 

I think the answer is, and I would love to hear alternatives: Teshuva, such that Hashem could say eidus that he will not return to the aveira, requires higher vigilance for the rest of your life. So the Darkei Teshuva are the things a baal teshuva has to be mekabeil forever to make sure that he doesn't fall back into the old ways of life. In that sense, they are an essential part of basic Teshuva. As such, they are מקרעי גזר דינו של אדם


So we have, I think, a good pshat in the Rambam, combining the Ritva and Rabbeinu Yona.

וביאר החפץ חיים שם שיש להשי"ת שתי הנהגות שונות האחת שמתנהג עם האדם במידה הדין ובהנהגה הזו בודקים כל מעשה מצוה אם נעשתה בשלימות בכל פרטי דקדוק הדין ובאהבה ויראה ובשמחה של מצוה כמו שכתב המסילת ישרים פט"ז ?כשם שאין עולה על גבי המזבח של מטה אלא סולת נקיה מנופה בשלש עשרה נפה שכבר טהורה לגמרי מכל סיג כך אי אפשר לעלות על רצון מזבחו העליון אלא המובחר שבמעשים הטהור מכל מיני סיג״   וכן בודקים כל תשובה על חטא אם היתה תשובה שלימה ולפי חשבון כזה יהיה נחשב בשמים לרשע וההנהגה השניה היא במידת החסד והרחמים ולפי הנהגה זו ״יצוייר שאפילו אם לפי חשבון פעולותיו עונותיו מרובין מזכויותיו אם הקב"ה יתנהג עמו ברחמים גמורים ימצא כמה מהעונות שנוכל לתלות עליהן שעשה אותן בשגגה או בסיבה אחרת וממילא אם ינטלו אותן העונות מן הכף יתרבו הזכויות על העונות ויקרא עליו שם צדיק״ וכן תתקבל תשובתו ״אפילו שלא היתה תשובה שלימה כראוי״ וזהו השוחד שהשי"ת מטה את הדין לצד הזכות.

באיזו משתי ההנהגות מתנהג השי"ת עם האדם דבר זה תלוי באדם עצמו. כי ״אם דרכו היה בימי חייו שלא לוותר לזולתו כלום משלו ושלא לרחם עליהם הוא מגביר למעלה בזה את מידת הדין״ ו״אם דרכו להתנהג עם אנשים במידת החסד 
והרחמים ההוא מעביר על מידותיו ואינו מקפיד על מי ורוון לו עול בכל הקפידא הוא מעורר כנגדו למעלה את מידת הרחמים.... וזוכה גם כן שיתנהג עמו הש"י במידה הזו בשעה שהוא צריך לרחמים. וזוהי כונת חז"ל שהקב"ה לוקח שוחד מן הרשעים בעולם הזה תשובה ומעשים טובים דהיינו מאנשים כאלו שעל פי מידת הדין הם נחשבים לרשעים אך אם הם מתגברים על יצרם ועושים מעשים טובים כלומר מצוות חסד וצדקה כי זהו המובן הפשוט של מעשים טובים אז הקב"ה מתנהג עמם מידה כנגד מידה ומגביר את מידת החסד שלו ביחסו אליהם ודן אותם ברחמים ומקבל מהם גם תשובה שאינה שלימה תשובה של רשעים כי אם שבים בתשובה שלימה אין זה שוחד מן הרשעים ומעשי מצוות שאינן מושלמות ואף את העבירות שלהם דן לכף זכות ומתחשב יותר בנסיבות מקילות ועל ידי כן הם נחשבים לצדיקים וזוכים בדין.

 ״חסד ואמת נפגשו צדק ושלום נשקו״
על פי האמור מסביר החפץ חיים זצ"ל אהבת חסד שם את הפסוק תהילים פה יא חסד ואמת נפגשו צדק ושלום נשקו וכך כתב ״ולכאורה מה שייך פגישה או נשיקה אצל המידות אבל לפי זה ניחא מאד דמידת הצדק נקרא כשהקב"ה מתנהג עם האדם בדרך האמת והצדק״ - במידת הדין - ״וכמו שכתוב צדק צדק תרדוף ומידת השלום נקרא כשהקב"ה מעביר על הענין וכמו שמונח שם שלום״ דהיינו כמו שעשיית שלום בין אדם לחבירו מובנה הוא שמשלימים זה עם זה על אף שהיו סיבות למחלוקת ומריבה ביניהם אך הם מוותרים זה לזה ומעבירים על מידותיהם על מידת הדין ומתנהגים זה כלפי זה ברחמים כך גם הנהגת השלום של השי"ת משמעותה היא להעביר על מידת הדין הרואה את החסרונות בדקדוק ולהתנהג עם האדם במידת הרחמים המעברת את תוקף החסרונות ולהביט על מעשיו הטובים כמושלמים אע"פ שאינם כך כי שלום גם מלשון משלים כי השי"ת כביכול עושה אתו שלום אע"פ שחטא ומחשיב את מעשיו הטובים כאילו היו שלמים 


ולכן אמר אם האדם בחייו הוא דבוק רק באמת שהיא התורה ולא בחסד אז אחר כך לאחר מותו בעת שידונו אותו בבית דין של מעלה לא יכול להתחבר בדינו מידת הצדק והשלום כי מידת הצדק אינו מסכים שיוותרו לו אבל אם בחייו נפגשו אצלו שני המידות של חסד ואמת יחד עבור זה לבסוף צדק ושלום נשקו' היינו שמתחברים אלו עם אלו שגם מידת הצדק גופא מסכים שלא לדקדק אחריו כל כך כלומר אם האדם מחבר ללימוד התורה שהיא הדין והאמת גם את מידת החסד כי עוסק הוא גם בחסד נוצרת מהמיזוג הזה שלימות בנפשו בגדר של מידת הרחמים כי המיזוג הנכון והשילוב הראוי בין חסד לדין הוא הרחמים שהוא תפארת לאדם כי היא השלישות המתבקשת והרצויה ובכך יוצר הוא שלום בינו לבין קונו כי עשה את רצון השי"ת בשלימות ולכן בהנהגת מידה כנגד מידה הקב"ה עושה שלום למעשי האדם הזה בדין שמים כי מתנהג עמו ברחמים ומחשיב את מעשיו כשלמים אע"פ שבמבט האמת והדין אינם שלמים ובדברינו יובן היטב מאמר חז"ל ב"ב י כל צדקה וחסד שישראל עושין בעולם הזה שלום גדול ביניהם לאביהם שבשמים 



In the last paragraph of the Chafetz Chaim there in Ahavas Chesed, he sums it up- 

ומעתה נבין היטב על מה זרז השם יתברך את האדם בכל התורה למדה זו. דהנה ידוע, דהשם יתברך חפץ חסד הוא, כדכתיב בקרא (מיכה ז' י"ח), ורוצה שיצאו בני ישראל זכאים בדינם לעתיד לבוא, ולא חיבים, חס ושלום. לכן צום בכמה מקומות ללכת בכל דרכיו, שהם דרכי הטוב והחסד, כדי שיהיה יכול להתנהג עמהם לבסוף גם כן במדה הזו.

הדן לכף זכות בשמים ידינוהו לזכות נמצא שהדן את חבירו לכף זכות בתוככי לבו מתוך הגברת האהבה וצמצום השנאה ושאר מידות רעות בזה הוא הופך את טבעו ומידותיו מרע לטוב ומתעלה במעלות המידות והקדושה וקונה אותן לקנין בנפשו וממילא מקטין הוא את כח הטומאה שבנפש. לכן אף כאשר הוא חוטא פחותה הטומאה שעוונותיו מייצרים הן באופן טבעי מפני שכאשר הוא נכשל בעוון מידות רעות כגון בכעס כעסו' מרוסן וחלש והן באופן סגולי שנפש זכה וקדושה, מייצרת טומאה קלושה יותר. ולכן גם בשמים דנים אותו לזכות כי באמת מציאות הטומאה שיצר היא פחותה.

    1. If the tzedaka is a cheilek of Teshuva, then it is necessary to remove the aveira. To remove an aveira we pay every penny we have. If the tzedaka is for a zechus, then all the dinim of tzedaka apply, including the din of chomesh.

  2. My first instinct is to point out that it's not an either-or. Among the tools Rav Shimon added to Rav Chaim's derekh when making his own was the concept of "hitztarfus".

    My second thought was to bring in the Maharal on Avos 1:2. Leshitaso, Torah is about our relationship to ourselves in general, Avodah refer to bein adam laMaqom, and Gema"ch is our relationship with others.

    And if we divide our avodah this way, then the line from Unsaneh Toqef is an echor of the mishnah. Teshuva repairs the self, tefillah connects us to the Borei, and Tzedaqah, to others.

    Which would place tzedaqah in a position where you really can't make the chiluq you're making. It is indeed part of the general picture of teshuvah in that it's standing in for azivas hacheit and qabbalah al ha'asid when it comes to bein adam lachaveiro. And yet it really is also tzedaqah, in the usual sense of tzedaqah.

    Last observation, until you get to the nafqa mina of al yevazbeiz, your question could have equally been asked of tefillah -- does this mean tefillah as the mitzvah of tefillah, or as part of the general concept of teshuvah? I would give the same "answer" of questioning the validity of the chiluq.

    2. R Micha, you should know that at our Kiddush Symposium this morning I said over several of the approaches, but your won the Kiddush, by far. One of my friends, a very, very, tough sell, (a classic example of "You can always tell a Harvard man--but not much." Except that he's Oxford and University of Chicago Philosophy and Classical Languages.) not only said it was good, which he sometimes says when he's feeling kind, but for the first time said "That is something that I would say over."

  3. I have no mekor for this, but perhaps because teshuvah largely involves introspection and self-evaluation, tzedaka is the best possible way to accurately assess one's madreiga to oneself. When I take a lulav and esrog or don tefillin, there is very little I can do to be aware of my level of performance. But the mitzva of tzedakah includes so many variables, such as the amount (acc. to my means), the way I give (bi'tzinah, b'kavodig etc) how I feel (happy, regretful, etc) and of course, the amount of bitachon I have is easily realized through tzedakah. I cant think of a better gauge to ascertain to myself exactly where I am holding.

  4. That's an interesting thought. But it is too big a chiddush to not have a mekor. I would agree, however, that it works well with the Rambam in 3:4, where he says ומפני ענין זה נהגו כל בית ישראל להרבות בצדקה ובמעשים טובים ולעסוק במצות . So there I would say that Tzedaka is a perfect mitzva, a mitzva that brings out all your kochos and kavanos. But in 2:4, I'm not convinced.
